Hi,

Can anyone advise if I can claim compensation in the following circumstances:

Myself and my partner travelled with Brussels Airlines from Manchester to Toulouse, France. The flight had two stages, both with the same airline, 1st leg from Manchester to Brussels and then Brussels to Toulouse.
The flight from Manchester was somewhat delayed due, we were told by the captain, to problems at Brussels airport.
Half way through the flight to Brussels the cabin crew told us that we had missed the connecting flight.
When we got to Brussels we were told there were no more flights to Toulouse that day. The airline accepted responsibility for the delay so put us up in a nearby hotel, gave us an evening meal and breakfast and booked us on their next flight to Toulouse..
The next day, at 1030 hours, we caught the flight, which itself was delayed for half an hour or so.
If everything had gone to schedule we should have got to Toulouse at 2230 hours on the Friday night and we actually got there at about 1330 hours on the Saturday.
Therefore, a delay to our journey of well over three hours with the Airline seeming to accept it was their fault and responsibility.
But is this circumstance covered under EC Regulation 261/2004? If not, is it covered under any other regulation?

Any assistance gratefully received.

My opinion is if the tale you were told is correct you do not have a claim.
Fortunately the airline appear to have looked after you very well during your delay.

you posted this same post on this thread 45 minutes ago!
• Thank you very much for your replies.

I'm not sure exactly what the cause of the delay from Manchester to Brussels was in this case. Apparently one of the runways at Brussels airport was undergoing maintenance so was out of service at the time and there was some other issue with the airport but I'm not sure what.

The flight was only delayed by 44 minutes according to flightstats.co.uk so Brussels Airline obviously decided not to hold the flight to Toulouse before they knew when the flight from Manchester would land i.e according to flightstats.co.uk the Manchester flight landed (at 8.39pm) before the connecting flight to Toulouse took off (8.45pm).
• Sorry about that. Lots of thunderstorms here so internet is up and down all the time so wasn't sure I had posted. Also not sure how to delete a duplicate entry

Being a bit more awake this morning, I was looking at dates for the wrong holiday.

I looked properly just now and i have found the flight, was a completely different airport. So now i have some more details to go on :rotfl:

9th May 2010 - dalaman to glasgow, 249 minutes late

Note to self: stop doing these things in the early hours.

Awful customer service yes, grounds for compensation probably not. Ash cloud constitutes as extraordinary circumstances AFAI:(.
• please can you tell me how to find out the date when the flight was cancelled as i cant find it on my bank statements

What a bizarre post?!?

spurss1, I've looked on my bank statements and your flight details are not on there either. Several other forum posters are now checking theirs and will no doubt report back.

Can I suggest, if you think about it, you have a bit more information on this than we do...

Unless the runway maintenance was an emergency I do not see why you do not have a claim. Surely Brussels Airline would of been informed of this a few days before
• Can anyone point me in the right direction?? I'm currently not happy with the response from TUI where it's claimed Extraordinary Circumstances, although I'm not convinced. A very lengthy, complicated response, clearly aimed to confuse and put off going further. Anyway I responded saying I did not agree with their decision, mainly as no specific detail was provided and I got the sense I was being fobbed off. I now understand that I can't refer to CAA as my flight was delayed leaving Ibiza, but need to refer to Spanish Authorities. I'm struggling though to work out how to go about it, I have been on the EASA website but still not clear. If anyone has had experience with communicating with the Spanish authorities I would be grateful if you could share how you went about it.

Many thanks
