Hi,
I was looking into reclaiming compensation/refund for my flight which had a delayed departure of 3 hours 5 mins, and a delayed arrival time of 2 hours 40 mins, and was looking how to do this on one of the money savings page, which says the first step is to complain to the airline, and it lists airlines which you can claim from. However, I flew with Cyprus Airways and this is not listed on this form - is this airline included? Also, what would people advise that I claim for in terms of how long I was delayed (considering I the departure time was over 3 hours, but the landing time was less than 3 hours).

We put in a claim for delay over 17 hours with Thomson this was for November 2007 They are refusing to look at this due to only allowing 2 years They advise they have consulted pre-eminent aviation law QC and state that claims must be brought with 2 years whether under EC or Domestic law They also state that Domestic law should dictate the time limit.
This flight was returning from Fuerteventura, so I would have thought domestic law not applicable.
They then go onto National Law and they state article 35 of Montreal convention.
Has anyone else had this reply? and if so how did you deal with this0 -

Ok, this is our scenario, we due to fly to Bristol from Girona at 07:30 on the Tuesday morning. Once we boarded the flight were advised of a delay, after 2 hours Ryanair decided to cancell the flight due to industrial action by French ATC. When we eventually reached the Ryanair desk we were offered a flight 2 days later on the Thursday as the flights before then were unlikely to depart. We were given 2 nights B&B in an airport hotel, however we incurred other expenses such as meals, transport costs to the local ATM etc. So in summary, our flight was cancelled and we flew 50 hours after the original departure date/time. Can we claim for delayed compensation from Ryanair ? Any help would be great.0

On Friday 30th May 2008 myself, my wife and a colleague were booked on the flight from Manchester to Puerta Plata in the Dominican Republic. We were delayed by 12 hours due to a technical fault with the aircraft and eventually flew out on a Polish operated relic. When we arrived in the Dominican the consequences of us being late transferred to the hotel because when we got to our room it hadn't been prepared as they'd had to look after the delayed passengers returning home. We eventually got to bed some 30 hours after leaving our home, but day one of the holiday written off.
Further to this and to add to our less than wonderful Thomas Cook experience, the flight home was delayed by 5 hours.
I wrote to Thomas Cook when I got back and who replied and, despite saying the flight out was a technical fault, they basically said it was nothing to do with them and I should try my insurance company, who of course didn't want to know.
When MMT introduced us to the compensation available for this type of situation I must admit I did develop a smug grin and had no qualms whatsoever about pursuing compensation, there was no ethical dilemma as far as I was concerned.
Using your links I emailed them and, not particularly sympathetic again, said unless I had boarding cards or holiday reference numbers etc then I was essentially snookered. After this length of time and after being told in 2008 I didn't stand a chance of compensation, all those details have disappeared. I wrote back explaining this and asked ,actually how difficult would it be to find in their records the passenger details of the flights on those specific days, particularly as they used a Polish operated, circa 1970s, replacement aircraft, but they didn’t respond to that.
My question is, would it be unreasonable given the information I have supplied, for them to carry out my request for compensation and does anyone feel, with regards the information i.e. specific flight dates etc that it would be worth going to the CAA?
Finally, a couple of developments have surfaced since writing to Thomas Cook. After looking in an old suitcase prior to getting rid I found my boarding pass for the return journey so I can at least pursue that legally but now comes one of Martin’s money dilemma’s, we have made acquaintance with a Thomas Cook employee and I am seriously contemplating asking them to dig out the flight details for a percentage of the compensation. I more than likely won’t take this course of action because it could put their job in jeopardy and do I really want to lower myself to their level, I am just tired of their BS.0 -

My daughter & her boyfriend were flying out to Sidari from Manchester with Small planet Airlines in Aug & they had a 24hr & 30 min delay at Manchester in that time they were mostly kept @the airport with no offer of vouchers for food or drink, not enough pillows or blankets.They were eventually taken to a hotel over night.
They have tried to claim from insurance, got offered £40, & Olympic Holidays offered them a £100 between them which was rejected.
Small Planet too told them to go to their insurer.
There is as you can imagine a lot more to this, we'll about three a4 pages, but all in all can the claim & is it to Small Planet0 -

Industrial action would likely be classed as exceptional circumstance so no compensation due. Ryamair should reimburse you for your meals during the delay, so if you sends your receipts in to them they will reimburse you0
