Hi there, got flight with easyjet on sunday from edinburgh-gatwick. Was supposed to leave at 21.15 but we didnt leave until 00:30, all we were told that it was due to 'late departure of inbound aircraft to edinburgh' is there any case for compensation?0

On the 25th July 2010 I was delayed for 12hrs when flying from Gatwick to Zante due to a technical problem.
I believe that on the 17th August 2010 (is this date correct?) the High Court requested that the claim for compensation for delayed flights be reviewed by the ECJ. However would my claim still be valid under the EU261/2004 legislation for delayed flights as when my flight was due to depart the review had not been issued?
If someone could help me I would be most grateful as i have already sent a letter to the airline requesting compensation however they said no because of this new review.0 -
Is there a time delay on claiming the compensation for delays?
I was delayed in January for over 25 hours (flight wasn't cancelled). Can I still put a claim in now?

Hi, I recently flew to Corfu with Monarch but the outbound journey was subject to a 28 hour delay due to a hydraulic problem with the plane. As I understand from the moneysavingexpert website, I should be entitled to 400 euros compensation as the distance is over 1500km. After phoning Monarch I was told they weren’t offering compensation as airlines were fighting this legislation in court. They suggested I claim compensation through my insurer. Is there really an ongoing court case or was I being fobbed off? How would you recommend I proceed?0

Hi, reading this thread as my daughter is currently delayed at Athens airport. Expected delay of 9hours.
Looks as if she is entitled to claim for a minimum of 400euros compensation.
Understandable that the airlines are fighting this in the EU courts at the moment. If they are forced to pay up then loads of airlines will just go bust! So I can't see the courts ruling in favour of the passengers unfortunately.
Probably the best thing to do is to try to come to a compromise individually, my negotiations start tomorrow when she has finally arrived home. From past experience the airline will come up with a load of lies about not being liable for one or another rubbish reason. Thanks to this forum + a general rummage round the internet I will be able to shoot these excuses down! Thank You :T0 -

i was on that flight too!!!! im not sure about what they told you because it is a seperate matter from insurance. i haven't tried complaining yet though0 -
I've travelled with my 2 children in August 2010 by Ryanair from Stansted to Brno and not only we've had 8 hours delay, but all Ryanair staff amazingly disappeared as they kept postponing our flight until night hours. No one gave us any information whether we could re-book or whether we are entitled to cancel altogether, or claim compensation.
They gave us a £3 worth meal voucher, which was more of a mockery on their side, because a single sandwich cost about £3.25. (and what about drinks at the price of £1.65 each for a bottle of water) We were supposed to land at 4:30pm on 30.July, but we landed in Brno 12:10am the following day - 31st and we had to take a taxi to our destination. I have no proof, since the driver didn't give us anything, so I have no idea how to claim this, but how did they suppose we would travel in the night, especially with young children?
Ryanair refuses to pay, saying that it was due to technical difficulty and therefore beyond their control. However, that's not what we've been told at the airport. I found on this site that in December 2008 the EU Regulations became more clearer and that actually more and more airlines were trying to get out of paying and made excuses about technical difficulties, which was supposed to be a good thing for consumers. Is it true?
I don't know what to do, but it feels wrong to let them get away with it. They don't let us get away with anything. They are charging practically for every possible thing that they could charge and are the most expensive - according to Budget Airline Check-in charges...on this site.
I just wish all the passengers from that flight would join their forces and do something about it. I have waited month and a half for Ryanair to reply and I've sent and email and letter by recorded delivery to which they've finally replied.
I know they won't pay easily, but what else is there for me to do?
If anyone has any suggestion, it would be greatly appreciated, or perhaps useful information or even experience with this. Thank you.0 -

I notice that you say about the court case being on stay because of the High Court referral back to the EU.
I am in Scotland, and the airline is Thomas Cook Airlines. Would my claim be under Scots' or English law? If it is Scots' law, then does the high court ruling also have a stay on me raising a claim?
I wrote a letter, based on your template letter for delay compensation. I received a letter within the 14 days saying that they would investigate and contact me soon (this was just before the High Court judgement). I have just received their letter, which does not even come close to answering why the aeroplane was late, mentioning the judgement and saying that they weren't paying out.0
