A European Court of Justice (ECJ) ruling last November gave passengers the right to compensation for long delays, not just cancellations.
But the High Court has, at the request of UK airlines, referred the matter back to the ECJ for a further hearing."There will be a further hearing and I don't expect another judgement until the first half of 2012," said a source close to the airlines.0 -

Wait 2 years to claim back the money Easyjet lost us due to their being unable to crew all the flights they had scheduled??
Any grounds for normal court action via negligence or incompetence?? Easyjet have cost me at least £1200 in re-scheduling connections and hotel stay - surely there's a chance to make the airline responsible for their own actions, or lack of?0 -

firstly i know all claims have been stayed in the uk but im wondering if i can claim anyway, some advise would be welcome.
We have just returned from a package holiday from hell with thomas cook and trying to reclaim some money. We flew with Thomas cook airlines as part of the package holiday.
On the outbound flight (Manchester - Antalya) there was a 4 1\2 hour delay and our return flight was delayed 3 hours. The return delay should have only been 90 minutes so they said we werent entitled to any phone calls or refreshments at Antayla airport, thou as soon as we cleared security into the departure lounge it changed to 3 hours! grrr lol.
Can I make a claim?

Yes, probably.
The EU regulations oblige the airlines to provide both CARE and COMPENSATION. The recent court ruling affects their obligation to provide compensation, but does nothing about the requirement to provide care. So you were entitled to food/refreshments, telephone calls and so forth while you were waiting. If you bought these for yourself and kept the receipts, then obtaining reimbursement should be straightforward. Otherwise, it would not be easy calculating an appropriate sum to receive in lieu of the care that should have been provided, but still worth a shot.0 -

Ive looked at my insurance policy and can see I should be eligible for compensation from that but do you think its still worth writing the letter provided in a previous post in this thread regarding compensation and sending it to Thomas Cook even though this new ruling puts any compensation claims on hold?
Regardless I am going to write a letter of complaint as it really did spoil the start of our holiday and we practically lost a day! I thought if I wrote them the letter about compensation and asked them to put it on file at least its logged and can be used for for future correspondense. Any thoughts appreciated

Cityboy has given you good advice. A couple of points I would add to that:
firstly, you had a right to care (refreshments, telephone call and so forth) while you were waiting, and this is not affected by the recent ruling. If you spent any money on a meal or whatever, claim it back. Otherwise claim a reasonable sum of money as a substitute for "care";
secondly, by all means claim on your insurance, although this is likely to be a derisory amount.0 -
Hi everybody,
I recently flew from East Midlands to Corfu with Viking. A substantial number of Viking customers were booked through the tour operator Kiss which recently went bust, and consequently Viking decided to merge some of its return flights from Corfu to the UK. This meant that my flight left twelve hours later than planned and was followed by a three hour bus ride from Gatwick to East Midlands, at considerable inconvenience to myself.
Unless these are counted as 'extraordinary circumstances', I am entitled to compensation. My position is that, while perhaps canceling the flights makes commercial and environmental sense for the company, and while I sympathise with them, the decision to cancel the flight was ultimately a commercial one on their part (presumably some payment has been received from Kiss for the seats anyway). They had planes and pilots available to fly me home, but took the business decision not to do so. Surely their obligation to compensate me for such a delay should be factored in to such a business decision?
Does anybody have experience of similar circumstances and whether they've had any joy pursuing compensation?

Just a clarification on the previous post, my flight was cancelled and I was put on a different flight to Gatwick. Is it only delayed flights that have had compensation suspended?0
