    I've contacted Thomas Cook about claiming compensation for our flight to Manchester from Turkey, which was six and a half hours late.
    They have said the delay was due to to a yaw damper fault, which raised concerns about the aircraft’s safety. I can confirm however that this fault has not happened to the aircraft previously and therefore this could not have been foreseen.
    Am I entitled to compensation in this case?

    I have read the criteria of the company concerned, yes if you opt for the best service it is £20.50, but if in the end the airline refuses to pay, claiming Extraordinary circumstances, they will charge you an extra £9.50 for a full document report, presumably to go to Court.

    I personally, when I was not aware of all the legal regulations, my rights, or this ebsite, etc, used a Dutch internet firm, at a cost of £18.91 + Dutch Vat at 19% £3.59, making a total of £22.50 back in January 2011. I cannot remember the company name, but it is internet based, and you have to supply all details first, they then tell you if you are eligible etc, and if you want to proceed, you have to pay the fee, and they issue to you via the internet, these letters which you have to send off yourself.
    For this sum they produce two letters defining case law etc, for your claim, one to the Operator (Iberia) in my case, the other to the CAA.

    In my specific case Iberia have made three different excuses, the last two atempting to claim extraodinary circumstances.

    So like this company you have stated, if no response is received or compensation is issued, you have to issue Small Claims Court Action, here in the UK via MCOL. I have done this, and am awaiting my day in court on 30/4/2013.

    It strikes me all the company is doing is compossing the correspondence, to be issued, if you have a airline that is refusing to compensate, or pay out, or accept your claim, then the onus is on you to either issue legal proceedings, or let them get away with it? It will be hard work to compile a Court case, you have to be methodical, have all the facts correct, etc. I even have the AESA regulator stating I should be paid, even their lawyers are not responding to my correspondence.

    So you see you cannot just pass it off to a company to do all the work for you, becasue in the end, it will still have to be you that issues the County Court Claim. Some Airlines are notorious for refusing to pay out, they probably expect 95% of punters will not be bothered to persue them through the Courts, but alas with me, they have bitten off more than they can chew, I will not back down.

    Thanks for that, I take your point too. I haven't committed to using them they were suggested by my travelling companion. I favour suing personally because I am really irritated with their attitude and it will serve them right.

    As someone previously pointed out, it doesn't encourage you to travel with them again, first and last time for me I'm afraid. Monarch have the worst record for delayed flights out of all the other airlines, impressive eh!

    I sent off an email to Singapore Airlines last year claiming compensation for a flight about 5 years ago and they replied (very quickly) saying that I had to put in a claim within 2 years.

    After my reply which pointed out that I had 6 years (and the case to back this up) I received no response. My three emails that followed also received no response (I was also asking for the exact cause of the 'technical difficulties')

    I put in a Money Claim Online claim a couple of weeks ago and received no response so I recently applied for a judgement. Is there anyone here familiar with the system? My main questions are how long this judgement takes (weeks or months?) and whether it will be likely that I have to go to court?

    Hi there. I went to Greece on an Olympic package holiday last year. The flight was delayed about 6 hours on the way out. However, the airline, Strategic (can only assume the name was ironic) has now gone bust. Can I claim from Olympic Holidays?

    There is nothing in the FAQs (as referenced higher in this page) to say that your case is against the airline and only the airline, whereas it does say that Package Holiday Flights are covered, so perhaps brixx could be forgiven for asking the question.
    I thought the FAQs used to say something about the case being against the airline, but then again I have read every post since the forum started and I am probably confused as to where I read that info (many times...).

    Perhaps we could get this added to the FAQs in the hope that we can avoid the question cropping up again quite so often?

    It was a perfectly reasonable question that I didn't think was definitively answered in the FAQs. I make no apology for the last comment I made. I thought one of the *points* of this forum was to ask questions if you were unsure. It wasn't a rude question, and there was no need to be rude in response. And BOLD CAPITAL LETTERS IN RED WITH AN EXCLAMATION MARK IS RUDE!
