Well I have the anticipated reply from Monarch after many weeks they are hiding behind the 6 year limitation act so apart from sharing the horrible experience (flight takes off from Gambia with not enough fuel then electrical problems and a nightmare diverted overnight stop in Tenerfie) with another forum user on the same flight nothing ! :mad:
Good to know, though, that Monarch recognise the 6 year limitation, so they won't be falling back on the "Supreme Court in the UK says it's two years" claim, as Thomson are currently trying...
(also... why has this forum become so wide? It's irritating having to scoot left and right all the time!!)0 -
Well spaceaarvark its a proven fact the 6 year limitation and Thomson should know that any challenge will cost them !0

hi could someone give me some advice please. we were delayed at zakinthos for over 8 hours. the incoming flight had been diverted to Gatwick from Birmingham because the first officer had been taken ill. monarch state they couldn't find aircraft or crew to fly on to zakinthos leaving us stuck at the airport for 11 hours. do you think I have a case for compensation? im not sure. thanks for any advice.0

Yes you have but copy/paste your query on the Monarch thread and see if anyone else has listed this flight and go from there.0 -
I have just been rejected for compensation (for a 24 hour delay) by Virgin Atlantic (Antigua to Gatwick Nov 11) because they say the aircraft had a problem with the number 1 engine (the cause therefore was extraordinary circumstances, which were beyond the actual control of Virgin Atlantic and could not have been avoided even if all reasonable measures had been taken).
Is this a valid excuse to be refusing compensation and should I pursue this further?!0 -
Hi, Can anyone help. i was delay in 2011 to and from Egypt, i have all the details, dates, times, flight numbers, booking reference. When i put the details into the checked it comes back with nothing. Is there somewhere else i can find out exactly how long i was delayed. Or is it possible to start a complaint, without the actual length of the delay. Any help would be appreaciated! Thanks0

Thanks to MSE I have received £1590 compensation from Thomas Cook.
I will not bore you with the details of our tedious delayed flight from Birmingham to Hurgarda with our 4 yr old back in Jan 2011.
I learnt that I could claim compensation from this website, I did not have any of our boarding passes, but as it had been such a horrible ordeal and with nothing to lose; I thought I would try & claim compensation anyway.
8 Nov - I sent a letter(used the template provided)
14 Nov - I received the standard TC reply " Our booking conditions state that a letter of complaint or claim for compensation should be sent to our Customer Relations Department within 28 days of their return from holiday".
I replied "the regulations do apply to package holidays and claims can be made within 6 years of the incident.I await your reply within 28 days."
4 Feb -As hadn't heard from them I wrote to tell then I would refer the case to CAA.Within a week I received a voucher for £1590. I politey replied that I had already booked my holiday for this year and requested a cheque instead.
I received the cheque today.-

Better luck than me, Monarch have just knocked me back a second time. Do I write to the CAA next or use a website who will deal with it for me for a flat fee of £20? According to their "check list" I am entitled to compensation.0

Flat fee will be for advise and writing letter to Monarch but not for taking to or representing you in court.0
