  • Hi can anyone advise me on this. In 2010 we were delayed for 10 hours on a flight from Menorca to East Midlands on a Thomson Airways flight. I've sent all the info off to them but just had what looks like a standard email saying the claim can't be considered as it is more than 2 years old. I wasn't aware there was a time limit on claims. Does anyone know if this is correct. Thanks

Read the FAQ and search the forum. The wisdom you seek is there. And if you can't be bothered, nor can I.

End of a long week. And I lack the grace and patience of Centipede and Mark2Spark. But even so - the truth is out there ...

This thread is for questions of a non-specific nature or for questions regarding the Regulation or precedent case law.

Please read the FAQs (https://forums.moneysavingexpert.com/discussion/4421185) before posting your question as the answers to many of the questions posted are contained within the links on that page.

If your specific question is not covered in the FAQs please post your question in the airline-specific thread in this sub-forum which has been set up to answer questions related to the airline involved in your claim. In that way, you will also be able to discover what similar issues others are having with the same airline.

Thank you for your support and cooperation.

Whilst I wholeheartedly agree with the sentiments of this repeated post, I believe it now falls into the category of the similar advise that we give to posters, ie not to engage in correspondence with the airlines, keep it short and sweet, 14 days NBA and off to court.

The very next post after you had posted this today shows the value of this repeated post. :undecided

It might be time for this thread to be closed.

Hmmm, not sure that I have that much patience to keep seeing the same questions over and over, when the work that has gone into updating the FAQ's to give the relevant info is there for all to see (with just a bit of savvy).

If you take the NBA and MCOL route and you go on to lose, can the airline (in my case, Monarch):
    - Have the court charge you for their costs?
    - Counter sue with their own case (after yours is thrown out), for any and all associated costs?

It still seems to me that many of these cases could go 'either way' - and jumping on the MCOL bandwagon too quickly could leave me in a worse situation.

Unless the above is impossible, I think I'd prefer letting a claim company do the work.
I have heard 'flightmole' being suggested. Any others (especially any with known successes) would be appreciated.

    Thanks.

Well I have the anticipated reply from Monarch after many weeks they are hiding behind the 6 year limitation act so apart from sharing the horrible experience (flight takes off from Gambia with not enough fuel then electrical problems and a nightmare diverted overnight stop in Tenerfie) with another forum user on the same flight nothing !

RWT: You're not surprised, though, surely? After all, Monarch are refusing to pay out when the law says they need to. Why did you think they would pay you when the law says they don't have to?
