    If the flight was departing the EU then EU regulations still apply even for non-EU airlines
    Did you eventually travel? If you had to buy a new ticket elsewhere you should be able to fight for a refund of the unused ticket. If you used your ticket then there is no refund due

    I used the ticket as I needed to fly out urgently so waited it out. It was a 5 hour delay from London Heathrow and consequently a 7 hour delay with the connecting flight at Dubai with the same airline to Karachi Pakistan.

    They say it was exceptional circumstances though as the last minute fault in the airline was out of their control.

    No compensation in that case?

    The law doesn't apply to exceptional circumstances. Only extraordinary.

    They obviously haven't bother to read the relevant ruling which states they don't have to pay if there was an "extraordinary" circumstance beyond their control. Doesn't say anything about exceptional ones!

    Has anyone else received a telephone call from the Monarch legal department?
    We received the first one a few weeks ago offering to pay our Court fee if we withdrew our claim (details in Post 489)
    We have this afternoon received a further call asking why we had not replied to their offer going on to say that it expired at close of play today. The caller was advised that we were not accepting their reason for EC and that we were awaiting sight of their defence. The caller then stated that she "will guarantee that we will be fighting this case wholeheartedly and will be putting together a defence tomorrow"
    According to my calculations they have until 12th March to submit their defence.
    Is it normal practice for legal people to behave in this manner?

    For those of you that live in Northern Ireland, I recommend you contact the consumer council to act on your behalf if you are getting nowhere with the airlines.

    I contacted them via their website, they called me back and wrote to Easyjet on my behalf. After numerous rejections from Easyjet for my claim, hiding behind the extra ordinary circumstances, the Consumer Council wrote to them once andEasyjet agreed straight away to honour the claim.

  • Hi all, I'm a little stumped as to who I need to initially write to. Here's my scenario......

    Package holiday booked via Thomas Cook in 2007, Bristol to Dalaman. We had a 10 hour+ delay. The flight out was with First Choice, who I believe merged shortly after with Thomson. Who do I need to write to first to get the ball rolling?
