If you bought an 'all-in' package holiday including flight from a tour operator then you can claim from them. If you bought a flight only from a tour operator, then you couldn't claim from them. If you paid £100+ on a credit card for a flight only, the advice of Which? is to claim from the credit card issuer if the airline's gone bust.
Sorry to butt in but do you have a link to the Which? article. I was delayed by 3 hours by Viking Hellas a couple of years back which has since gone bust, however it was a charter flight (only) booked by a tour operator which still exists.
  • Just got £ 965.00 from BA for our delayed flight to Mauritius last October. Had heard nothing from BA, except for an initial acknowledgement despite repeated reminders, but cheque arrived just two weeks after I e-mailed the Civil Aviation Authority to complain - coincidence?

BA has also agreed to separately refund overnight hotel etc charges but not my modest claim for lost business time in phone calls etc. They have, however, sent me a £ 400 e-voucher!

This may have been asked before, but it's hard to search for so here goes (@MSE - can you add whatever the answer is, to the main artcle)

If you have a booking from, say, Lima to London, with two separate flights (Lima-Madrid, Madrid-London), and only the second of those is delayed, what compensation level is applicable? Is it based on the distance of your total journey, or just the second flight?

    Hi,

Just to share my experiences, following on from Martins "how to guide" I contacted Easyjet to claim back delay compensation for a flight to Barcelona in 2010

Of course Easyjet came back, fairly quickly, with a no

I then took the next step in contacting the caa who upheld my complaint and so Easyjet offered €250 each for myself and my husband due any day now

    :j

Its worth a go and following through if you can remember a flight delay!

I was delayed for 18 hours back in 2005, I have traced the flight details online it lists the flight as being delayed. (British Airways) It was a technical fault with the wing that meant it had not left the UK to fly us back from Tenerife South. I do not have booking info anymore neither do I have the boarding card - can I claim under this new legislation without these documents or have I not got a leg to stand on??!! Any help would be appreciated.
  • My son, daughter in law and two grandaughters were delayed on a flight from the canary islands in 2010 for 7 hours and despite numerous letters monarch refuse to pay any compensation. They can't afford small claims court, but are owed in the region of £1600. What can they do next?
  • Our flight from Venice to Gatwick was delayed by 8 hours due to snow. I realise that the weather was out of Easyjets control however they only told us that the flight was going to be delayed after we had boarded the plane. There were still people waiting to board who they allowed to board and then informed them that there was a delay. The flight was scheduled to leave at 4:10pm but didn't start to taxi down the runway until midnight. There was not enough food on-board for all the passsengers to be given free refreshments. There was no hot water available for hot drinks. In the interest of 'fairness' all snacks had to be paid for. After three hours all those with smart phones including the pilot received a message from Easyjet advising them to go to the Easyjet counter to pick up a refreshment voucher. We were not allowed to get off the plane and the Pilot wouldn't allow anyone to bring any food onto the plane as this could lead to the plane losing it's place in the queue for de-icing. We could see passengers disembarking from the planes adjacent as one by one their flights were cancelled. Not Easyjet. We were informed that there was no accommodation available in Venice. After 4 hours passengers were told that they could leave the plane at that point but that point only however we were given the impression that if we did this it was our choice and Easyjet had no responsibility for making alternative travel arrangements. I fully appreciate that it was snowing but I don't think we were dealt with 'humanely'. On what grounds would we make a claim for compensation
  • I am arguing with Jet2 over a 7 hour delay which they say was down to extraordinary circumstances.
The reason being an issue with a PITOT PROBE HEATER.
I have now sent correspondence to the CAA and hope they can help.
But if they dont where do I go next??
I think that airlines can use any excuse as unreasonable.=, especially Jet2 who are SO POOR with customer relations.
  • Just to add my two pen'th.

We were delayed from Dalaman to Manchester last September (2012) for 10 hours+. We were told this was due to our Thomas Cook aircraft developing a fault on the runway at the last minute at Aberdeen airport. We were told it was on what I think they called a triangular route including 3 airports - Aberdeen to Dalaman to Manchester.

I have contacted TC by letter twice and called them today - they are going to attempt to fob me off I'm sure. They won't of course as I'll pursue them to the small claims court and get a writ issued if required.

Any thoughts on my chances would be greatly appreciated and good luck to anyone else claiming legitimately. I'll help if I can.

    Thanks folks
  • To whom it may concern (knowledgeable individuals),

I was delayed on a flight a few years ago. I remember the date of travel - however I do not have the booking reference number that was issued via the travel agency.
In attempting to contact the airline directly, they responded with a message requiring the booking reference in order to pursue the claim further.
Unfortunately the travel agency has gone through a system change between the time of travel and the current date - which has left them unable to provide me with such relevant details.
Is there any other way to search for a reference number short of contacting the airline and asking them to search their records (since I traveled with them!)?
Thanks in advance for your help.
