Compensation for delayed flights Discussion Area

Hi Jacqueline
We have been very candid and upfront about our processes. The claims are being processed on a flight by flight basis, not by the date received. Once we receive your claim form it is then passed to our operations and legal teams to fully investigate all the factors that were involved in operating your flight. Our investigation process includes liaising with both internal and external contacts to get a full picture. Unfortunately, this is a lengthy and detailed process and we are working hard to complete our investigations in order to respond to each claim as soon as we can.
Please be assured that all claims are treated equally and in order to be fair to all our customers cannot be fast tracked.
that is the explanation from Monarch0 -

Im currently claiming for an 8 hour delay to a flight on Xmas Eve 2012 via Easyjet from LGW to Paphos. We took off on time from LGW but were diverted to Brussels for 8 hours due to engine failure. A second plane was sent but was grounded upon landing due to an unnamed fault. Finally a third plane arrived and got us to Paphos in the nick of time.
Anyway, I have now escalated my claim to the CAA but have still pursued Easyjet in the mean time. After pointing out that technical difficulties are not extraordinary curcumstances about 3 times, including sending the relevant links, they have now come back with this little gem. Im sitting on my hands to prevent myself sending a very rude reply!!
I would like to inform you that I will be glad to offer you a compensation for the delay for the flight however as per the company policy making an exception for one passenger will not be fare and correct for the other passengers thus I once again apologise for the delay caused and I am sorry that I cannot process a compensation for the flight.
I'd promise never to use them again, but they are the only airline to fly LGW to PFO all year round for a reasonable price :mad:0 -
contradicting themselves then? What a bizarre statement. I'd like to see them explain that in court....If you're new. read The FAQ and Vauban's Guide

Hi
I'm interested in people's opinions as to whether they think we have a good case for compensation after the following nightmare flight .....
In Nov 2012 my friend and I flew from bham to sharm el sheikh with monarch. I booked flights directly with monarch.
Flight left on time, all fine, weather good. A little turbulence but quite normal. After nearly 4 hours pilot announced that he was concerned they were low on fuel and if there were any delays landing when we reached sharm , he might not have enough, and wasn't willing to risk it so we detoured and landed at Cairo to r fuel. At the time we were annoyed at the lack of fuel , but thought fair enough due to safety. Aspect. Refuelling took half an hour but when he then tried to push back, it was clear that the plane had developed a fault.
To cut a very long and horrendous story short, we were then stuck on the plane for 7 hours whilst they tried to sort the fault out. We were only offered a cup of water after an hour an a half and it was only after 5 hours the stewards re opened the bar / food trollies - all of which had to be paid for
Eventually the fault was fixed and the plane took off and we landed in sharm about 7 hours late.
Whilst I appreciate their concerns about fuel / safety , if they had fuelled the plane sufficiently at the start then we wouldn't have had to detour to cairo, and if the fault had then occurred at sharm they had monarch engineers at the airport who could have resolved the problem quicker (apparently it took so long as monarch don't fly normally to Cairo so there was a lot of red tape to get through to let other engineers fix a monarch plane.)
I didn't get round to complaining until now as I was unaware of this ruling and tbh we were treated so appallingly by monarch, I had just decided never to fly with them again. ( we kept being told to stay in our seats and it was only when I got off the plane in sharm I realised my calves and ankle had swollen up badly and were 'solid' this lasted for two days which was a bit scary !!)
Anyhow would appreciate people's views on whether we would have a claim or whether they would rule it as 'extraordinary circumstances'
Thank you in advance (0;0 -

Finally got a claim form from TUI. Just wondering if anyone has been successful without boarding passes? We have one but not the other.
Too soon yet to say whether it was successful, but I just put "Not Available" in the box for boarding pass. I supplied the booking reference and copies of our passports and in my covering letter I said:
The boarding passes which you requested were discarded following the flight and are therefore not available.
However, I am satisfied that the information I have supplied, together with your own records, will be sufficient to establish that we paid for and took the flight in question.
If you took the flight I cannot believe there is any chance that they will reject a claim just because you no longer have the boarding pass. Assuming that you have a valid claim it would just be inviting you to go down the legal proceedings route.
(They also say, and underline "It is also essential that you send us your flight tickets". Well, my flight tickets were surrendered at check-in, so I pointed out that I could not supply those either).0 -
Hi, i recently submitted a claim to Ryanair for a cancelled flight in 2007, and i have just received an Email from them to say they have rejected my claim, as it says in their "small print", that all claims must be submitted within 2 years. The basics of my claim are as follows:I was due to fly from Carcassonne (France) to Stansted Airport (U.K.). When i got to the airport i was told the flight was cancelled (no reason given), and that i would have to come back the next day for the same flight (no accomodation, travel, food Etc offered). As i had to be back in the UK that day, they ended up re-routing me (no extra charge) to Edinburgh Airport via Shannon Airport. I arrived in Edinburgh at 6.25 p.m. (I was supposed to land at Stansted at 2.05 p.m.). I then had to get a train home, arriving at 11.45 p.m.
Do i have a valid claim, and what should my next step be, as Ryanair have rejected my claim?
Thanks0 -
can anyone advise me on what to do next, do i have a case?

Onarriving at Las Vegas airport for our return flights we were informed thatDelta had cancelled our flights as they did not have any record of us arrivingin Las Vegas. A Delta representative the booked us on the following flights.
Departure: Las Vegas
Arrival: Salt lake city
Airline:Delta
Flight:DL170
Connectingflight was delayed.
Departure:Salt Lake City
Arrival: Paris, Charles de gaule , Tuesday 06/01/09
Flight:DL170
Flightwas late in landing missed connecting flight to Amsterdam, no suitable flightsuntil the morning, had to spend the night in Paris. We were also told not to pick up our luggagethat it would you on the next flight with us and go straight through toGlasgow.
Wednesday07/01/09
Departure: Paris
Arrival: Amsterdam
Flight:AF1240
Flightwas delayed missed connecting flight to Glasgow, KLM issued another flight.
Departure: Amsterdam
Arrival: Glasgow
Flight: KL1475
Arrivedin Glasgow luggage was lost again filed a report, did not receive luggage until12/01/09.
Weshould have arrived in Glasgow on 06/01/09 at 9.55am, but instead arrived inGlasgow on 07/01/09 at 2pm. We were dueto go back to work on 08/01/09, if our flights had went to plan this would havegiven us 2 days to recover from any jetlag. Instead we could not attend our work on 08/01/09 or 09/01/09 due tosheer exhaustion from the 3 days of travelling this resulted in a loss of earningsof £300.
after a few emails back and forward ive received this from KLM (Air France/KLM handles the correspondence of Delta Air Lines Customer Care in Europe)
Thank you again for your message in relation to the disruption with Delta when you travelled from Las Vegas back in January 2009.
Further to your claim, we would like to add that Delta Air Lines is not EU domiciled and your flight DL170 on 5 January 2009 was not departing from an airport located in a EU or EEA member State. In addition, your rebooked flights AF1240 from Paris Charles de Gaulle to Amsterdam and KL1475 on to Glasgow, on 7 January 2009 did not have a delay of more than 3 hours. Therefore, we are sorry to advise you once again that you are not entitled to the compensation established by the EU Regulation EU261/2004.
Thank you for allowing us this opportunity to clarify our position in this matter.
Yours sincerely,
Mr M. Garc!a.

I believe they are correct. Delta are not governed by EU regulations except in the case of flights departing the EU.
Did you get to the bottom of why your flights were cancelled as it seems that this is what caused the issue in the first place?
Did you have to pay for the hotel accommodation in Paris yourself?
Did you deal with your travel insurance at the time?0 -
