  • I have received another email today from BA offering the full 1800 euros in compensation for a flight delay in February 2009, well worth the cost of a stamp to send it.

    I am one of the Many Monarch claimants however i am wondering if it is worth pursuing as claim relates to a flight in April 2005 so i cannot use the threat of court action but my case is strong realised after take off not enought fuel then electrical problems resulted 25 hour delay and overnight stop via tenerife .Poor Gambians were locked in a room as no visa,s for spain !
    I have looked back a few pages but cannot find any help !

    Ryanair are likely to deny your claim and say 'fog' at every stage of your claim and if you start a claim in Dublin, they'll probably continue to say 'fog'.

    Do you have the tenacity to pursue a claim to the end with Ryanair, is what you have to ask yourself.

  • I have tried to claim compensation from Easyjet for a 7 hour delay. After several replies from an assistant, I finally received an email from their Escalation Team saying that the aircraft had had an engine surge, which required a boroscope inspection which could not have been foreseen and was therefore an extraordinary circumstance. Can anyone tell me if this reason counts as extraordinary? Thanks

  • Hi everyone.

    Had over a 7 hour delay on this flight.
    EasyJet were useless at Stanstead, denying us any assistance.
    Found the compensation ruling on MSE a few weeks ago, and made a claim.
    EasyJet tried quoting the Montreal Convention, and said that we were too late to claim.
    After much persistance they fanally settled.
    Won 2,000euros between the 5 of us (400euros each).

    One small victory for the little man v the big company.

    Yes Airbus with the common hydraulic fault.

    Quick query:
    Is it the general consensus (or established fact/point of law/ EU regulation statement) that a delay to one flight caused by delay to the previous flight of the same aircraft is not considered extraordinary circumstances?

    Not much point claiming with Monarch for delays dated 6 years or over, as I have just today received this response from a 24 hours delays from November 2006 (Hmmmm, just 30 days to late to take court action)

I also recognise that the care and attention you receive from our staff, especially when things go wrong, can go a long way to reducing any stress and anxiety that may be experienced. I would like to reassure you that every effort is made to ensure the flights operate on time and, in the unlikely event we are unable to do so, we aim to get you to your destination at the earliest opportunity. That said, our ability to keep disruption to a minimum is always dependant on the resources available to us on the day.

    You may be aware your claim for compensation pursuant to Regulation 261/2004 is a claim for compensation due under a legislative provision. The Limitation Act provides that, in relation to a claim for compensation under a legislative provision, any claim for compensation must be brought (that is, proceedings issued) within 6 years of the date that the cause of action accrued, which, in this case, is the date the relevant flight arrived at its destination. In this case, more than 6 years have elapsed since the flight of which you complain. I am therefore unable to agree to your claim for compensation.
