  • I sent the letter for compensation to US Airways to claim for a delayed flight in 2008 from Manchester to Miami with a connection in Philadelphia.

    The flight was delayed on the runaway for 4 hours (after we had boarded) due to a technical fault which meant we missed our connection in Philadelphia and didn't arrive until the following day.

    US Airways have now responded saying that as they performed all the necessary maintenance checks and took all steps to prevent a mechanical cancellation or delay they are not obliged to offer compensation under the terms of the EU ruling.

    They have however said they will offer us each an $800 voucher to use on a US Airways flight to be used within the next year.

    Not sure if I should push for more with them as ideally I don't want to fly US Airways again as they were terrible at the time. On the other hand I think it might be unlikely I get a better deal than a free return flight to the US. Any ideas on how I should proceed?

    Also I had a flight back from Las Vegas in 2006 cancelled due to a mechanical fault BMI were unable to fix. Ended up returning over 24 hours late via a Virgin flight to Gatwick and then onto Manchester. The problem is I cannot locate any of my flight details. Does anyone know how I could go about obtaining these? I know the date and flight number of the flight but not much else.

    LHR-Miami is over 3,500Km so you are entitled to 600 Euros each.
    US Airways ARE obliged to pay as technical faults are not "extra ordinary" circumstances.

    $800 is about 600 Euros

    PRO
    You get some re-imbursement now-As opposed to taking them to court.
    CON
    However you are stuck to using the voucher within a year and on US Airways.
    (You could sell it on Flea bay)

    BMI has folded IMHO you can't get compo-Though Centipede thinks (IIRC) you can claim against BA (who bought them out)

  • I send a copy of the MSE letter to easyJet on 10th November 2012 detailing my flight delay between Newcastle - Malta in December 2009.

    Had an email from customer services on 12th November 2012 explaining that I would receive 400€ compensation and a call back was arranged to take my card number.

    400€ (£330) in my bank account on 26th November... Btw, I'd previously submitted this claim via euclaim before the judgement that they didn't get anywhere!

    I am rather pleased!

    Its great to read that some of you are having success.

    I am waiting with interest to learn of someone receiving a settlement from Thomas Cook!
    I started out with nothing and I still have most of it left!

  • Hello everyone,

    Am after some help and advice.

    We went to Florida on 18th Sep 2008. We flew from Cardiff to Sanford with Monarch - ZB313.

    I cant remember the exact time but the original flight time was something like 6ish in the morning (maybe even earlier!). On arrival there we were informed of an 8 hour delay.

    The flight stats site that you use to check delays etc is showing it was scheduled for 1.20 pm and no mention of the original flight time. It states a delay of 110 mins which i find very fishy as its under the 2 hour delay compensation range.

    What do i do now?

  • Hi can anyone help with advice please!
    we booked a package holioday with Thomas cook and the flight from Gatwick to Cancun was delay by 30 hours!
    we are currently on resort only to be told today that the flight home, we were due to leave 4 hours ago, will also be subject to a 24 hour delay (minimum)
    ? do we have a claim for compensation here and can anyone advice, it seems we should be able to claim the maximum. Also as we have suffered 2 flight delays are we able to multiple claim, for the delays on the way here and on the way home.
    thomas cook have been very poor and offered no help or even a rep at resort, so be aware if you are considering giving them your hard earned cash, they must have known about the delay home some time ago.
    we have also incurred expenses as our poor dogs are now having to be passed from pillar to post until out return..... anyone who knows about this please help :)
