    Thanks Centipede,

    It wasn't clear regarding the 50% reduction. Seems very strange that you are entitled to more for a shorter haul flight delayed more than 3 hours... Still I should pursue the 600 euro claim for the two passengers. I guess this is my decision to make but is the next recourse small claims or is there a standard way of highlighting that they're 'giving me the run around' and I know it. Perhaps a way to try to keep it out of small claims?

    I would proceed, although Monarch are already clear that they are asking for it.
    It'd be interesting to see the outcome of a case where compensation was denied by the airline due to not retaining the original booking form. A case that then followed through to a court hearing I mean.
    But as you're probably already aware, you are up against it with Monarch anyway, even if you have all the correct paperwork.
    But it's been clear from the start, this is unlikely to be a simple letter writing exercise. Tenacity is required.

  • Our return flight from Heraklion on 9th October 2012 was delayed by 6 hours with Jet2 Holidays. Tech problem in Glasgow. So when we got to the airport, the plane hadn't even left Glasgow with the inbound passengers.
    Sent the template letter on 28th November and had a "We acknowledge your correspondence" letter from them today-1st December!
    I had already included a copy of my booking, and copies of my boarding cards.
    Letter basically says, they deal with all correspondence in date order, so if they are busy with lots of letters, it may be a while before they get back to us properly!
    But they can be sure, if it's not within 14 days, I'll be writing again.
  • Myself and family (four of us) were delayed going to Turkey, in 2007, by almost 7 hours. Other people on the flight received £10 vouchers each. We didn't, I guess I missed the tannoy announcement. I reported it on the plane and was told to report it in resort so I did.- Nothing. I wrote several letters on my return to First Choice and didn't recieve an acknowledgment even. As a result of my letters I still had, on file, my flight details. We were also delayed by just over 3 hours on our return receiving a burger chips and coke each I think. I have put in a claim for both flights for all four of us. The amount of the claim seems ridiculous (£2400) but I am still annoyed at not getting any reply (more so than missing out on £40 of vouchers). Guess what, just over 3 weeks after sending off the claims by post- Still no acknowledgement. 1 more week and I shall go to the next stage

    No, sorry. I just sent a letter to their Head Office, early October, with copies of all paperwork, boarding passes and the letter that was given to us explaining why the flight was delayed.

    I got the standard, "no sorry" email back. Once the court ruling ruled in passengers favour on the 30 Oct, I just replied to their email asking them to reconsider. Got my reply nearly 4 weeks later stating they will pay.

    Hope you get the same outcome :)

    This message querry is for Centipede 100, in your posting page 173 #3446, you answered a question re the CC stadard 8% interest chargable.

    Having had several County court cases in the past, (last being 2 years ago), like you stated, I inserted interest chargable on the N1form, from the date you submit your claim. You stated qoute "8% interest P.A. is claimed from the same date of yout MCOL or County court issued NI legall claim form, not before." end of quotation.

    In studying HM Courts EX302 leaflet, page 9 under the heading, Can I claiminterest on the money owed to me ?.

    Yes, if you want to claim interest, you should include the following text in the section titled "Particulars of claim" on the form:
    "The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of [8%] a year from [date when the money became owed to you] to [date you are issuing the claim] of £[amount] and also intrest at the same rate up to the date of judgement or earlier earlier payment at a daily rate of [daily rate of interest]".

    In my claim as the regulation EC 261/2004 was in force, albeit some airlines were trying to avoid payment, I issued my interest claim from the date of my arrival back in the UK. see postings #2016,2187,3285,3345,and on pages,101,110,165,168 respectively. Can you clarify pleas

    That is pretty much what I have done although we were not given a letter regarding the cause of the delay. The casue was confirmed verbally by BA groundstaff then again by the pilot before we took off.

    I'll give it another couple of weeks and see what happens.
  • Hi, I'm looking for some advice on the next step to take please.
    I was delayed back in 2009 for close to 9 hours. I've contacted Thomas cook (using the template letter on the site)who have replied with a letter stating that I needed to complain within 28 days of my return.

    Any help would be appreciated, thanks
  • A big thanks for the MSE article and the help on this Forum. In March this year we were set to fly to Tampa with BA. The flight loaded on time, but just before taxi-ing out the pilot came on the intercom to apologise for a short delay because of a warning light. This 'short delay' turned into a 27 hour delay!
    After reading the article and posts, only 10 days ago, I sent a compensation claim to BA and today have recieved the following reply;

    Thank you for contacting us about your claim for compensation.

    Following a recent decision made by the European Court of Justice, you are entitled to compensation for the delay of your flight BA2167 on 15 April 2012. The distance of your disrupted flight, as calculated in accordance with EU legislation, was over 3500km. Based on this, you are entitled to €600 in compensation.


    As there are two passengers included in your claim, the total compensation due is €1200.


    We are arranging to send you our cheque, which will be made out to you as the primary claimant, in your local currency. You will receive this under separate cover.
    Thank you for following this up with us and I hope you will fly with us again soon.
