I have written to Thomas cook, They have passed it on to someone and they will get back to me within 28 days. I have been reading on here, and it seems like I would be entitled to refund and compensation??
Only compensation for the delay as you did eventually get there so no refund.0 -
Hi Martin,
I followed your advice to the letter but sadly I got a response from Olympic saying they only had records going back to 2009 so they cannot do anything.
I copy their mail below.
Kind Regards
Neil
Dear Mr. Carr,
Thank you for contacting Olympic Air.

I should also have told you that there were four of us on a flight that was delayed for about 14/15 hours back in September 2008 so it is even more frustrating!0

At the end of last month the flight I was to travel on got diverted from Gibraltar to Malaga which meant that we were bussed to Malaga resulting delay 5 hrs. Now this was due to rain on the rock which often causes problems so I am sure compensation for delayed flight would be refused due to "bad weather". However, because of this I arrived at Heathrow after 10.30 pm when all the connecting coaches for Exeter had finished. I, therefore, had to stay in an hotel overnight and travel down the following morning. Can I at least claim for the hotel accommodation?
The same scenario happened to my son a few years ago but his flight was cancelled and Easy Jet paid out compensation. Never really understood why as again it was bad weather related.0 -
We were delayed by 6 hours on a flight back from Tenerife to Manchester (via Monarch) and they sent me the "sorry about the delay" email but citing "technical problems - flat battery".
Is this classed as an "extraordinary circumstance" which means I can't claim compensation?
I can't find a definitive answer?
Re the above, having read MSE (and other articles) I'm confused on one point - can somone clarify?
I know for sure I can now claim €400 per person for the 6 hour delay but can I also claim a refund of the flight cost as well (as the delay is over 5 hours?)
It would appear that I can claim both?0 -

No, as you took the flight, there's no refund to be claimed.0 -

IMO this will be one for you to chase your travel insurance company over.0 -

Why did you contact Olympic Air if they were not the airline you travelled/booked with?0 -

A tricky one IMO. As your flight took off, it was obviously given the nod as to it's airworthiness. So to develop a fault in flight which caused a premature landing could easily be argued as a safety issue beyond the airlines control (IMO). So the delay, whilst a right pain, isn't a compo one, the airline will argue that they got you there as soon as poss.
All very arguable though. Depends how persistant you want to be in chasing it.
It won't be a simple letter writing exercise, Court beckons after exhausting every avenue at out of court settlement (IMO)
