    I'm in Scotland. What's the difference between the county courts and the small claims?

    Where do I find their U.K. address? I had a brief google earlier but got distracted...

  • Flew British Airways, LHR to Larnaca last Tuesday and was subjected to a 4.5 hour delay. the original cause was a problem with the aircraft that couldnt be fixed. The delay increased when the replacement plane was also unserviceable so we had to wait for the plane coming in from Amsterdam that was due to land at 11am which was going to be used for our flight. We were due to fly at 08.45, and eventually took off at 13.22.

    So our situation seems to tick all the right boxes and this evening have compiled the letter and associated documents and will be sent off to BA in the morning.

    I'll keep you posted with the progress. Thanks to those who have posted the advice on this thread.
  • Fascinating thread but it's amazing how many people keep on asking about events years ago and airlines that have long since gone bust!

    Anyway, British Airways rarely come up so I intend to keep you informed how I get on with my claim in case it helps or encourages others.

    I booked return flights to fly with BA from Manchester to Newark via Heathrow on 29 June 2012. I made the booking through Expedia but I dont think that makes any difference. The Manchester flight, BA1399, was delayed several times eventually getting to Heathrow too late to catch our flight to Newark so we were put up in a hotel overnight completing our journey the following day, some 17 hours after we should have got there. The captain of the Manchester flight told us the delay was due to other delays that had built up during the day and we'd missed our slot and had to wait for another. To make matters worse they let some passengers off post boarding and then spent over an hour looking for their cases in the hold!

    Having heard about the court judgement I emailed BA two weeks ago initiating the claim process. I have received an automated response but nothing else. I sent them a reminder last week but this didn't elicit a response either so I sent them a letter last week by recorded delivery (which has been delivered) formally claiming my 600 euros compensation on behalf of each of the three travellers in our party. I gave them 14 days to respond so the clock is running. I have got my BA booking ref and flight stats confirms that the Manchester flight was delayed by over 3 hours. I don't have any boarding cards though and hope this isnt important.

    So, I think I have a valid claim and await BA's response with interest. If I hear nothing after 14 days I will follow up my letter with a LBA.

    I have contacted BA 3 times in the last fortnight by the electronic form (difficult to call as I am living abroad and the line is often of poor quality). BA have failed to even acknowledge my contact (except the automatic response). You giving them 14 days to respond is an interesting tactic. I watch with interest.

    I registered a complaint in January after a 24 hour delay due to mechanical problems with the plane on my holiday to Cuba last Xmas. I was stranded at Gatwick. I have exchanged emails with Thomas Cook and the last one is below can anyone comment o nthe validity of the claim made?

    I understand that you have questioned whether you are entitled to compensation as result of a flight delay you have experienced with us. Please note that the judgement in question present has been passed in the European Court of Justice and not yet been accepted in the UK Courts. It is for this reason that we are unable to consider any compensation at this stage.

    Interesting to read what TC saying regarding the new ruling not being passed in the UK. On FBI they state that they are now paying out for delayed flights.
    We have to take Insurance out, surely they take one out to cover themselves for things like flight delays. After reading that I am not holding out on getting anything off them.

    I put in a claim to Germanwings regarding an 11 hour delay to our flight due to a faulty part on the plane, and have contacted them again since the ECJ ruling but have received the following reply:

    'In this present context we cannot offer you yet the compensation claimed and still refer to litigation C-413/11 at the European Court. We are sorry that we cannot give you any other answer so far.'

    Does the ECJ ruling not apply in Germany or are they just trying to avoid paying out? Does anyone know what this litigation is? Should we go to a small claims court next?

    I was wondering if anybody had any experience claiming for a delay with Ryanair?

    I was delayed for 4 hours the other day, Ryanair have been helpful enough to provide me with an insurance letter (automatically generated I think) but my insurance only pays for delays of 12+ hours.

    I'm sure I'm still entitled to compensation, but does anyone know how to get it from Ryanair itself? I've tried calling and due to "exceptionally high volume of calls" I can't even get through!

    Advice would be much appreciated :)
