    Typically you would go to court with a pre prepared 'Statement of Issues' which would be set out like other court papers with 1.5 line spacings etc etc, this 'SoI' would list a brief Chronology of where the case has got to, to date, and what you are asking the Court to do (as a ruling).
    So something like:
    A flight delay occurred on *date*
    The respondent denied liability.
    The Court stayed judgement until the ECJ ruling.
    The ECJ ruling negates the defence offered.
    Compensation should be paid, within 14 days, as per the ECJ ruling.

    Hi,

    Would anyone be able to give me some advice. I have seen on MSE that we can claim for delayed flights back to 2005. I have a 8 hour delay flight in june 2011 with Thomson. As far as i can see i can claim. The only problem is i dont have any of the paper work i could kick myself as i only got rid of it about 2 months ago. I have all the details (flight numbers, time, confirmation number of our holiday) but no hard copies. Looked all through my e-mails paper work cant find any thing apart from that. Would this be enough or is there no chance of me getting any compo. Thanks

    I assume it's a European flight and therefore covered.
    IMO typically some evidence that you actually took the flight would be required, however the onus, seeing as you have the booking ref no (and i assume some evidence of paying for the flights/holiday) and other details would be on the airline to provide evidence that you didn't take the flight.
    How about mobile phone records of when you were abroad? Which could show that you reached the destination?

    All assuming that the change has occurred *less* than two weeks before planned departure day. Otherwise airlines are allowed to change.
    Infuriating I know. But you're entitled to a refund if the change isn't to your liking, and that's how it works.

    please can anyone help me -on friday 26th oct myself, hubby ,16year old son and 13 year old daughter were flying to sanford airport from gatwick with THOMAS COOK .the flight was 30 minutes late due to a technical problem .3 hours into flight there were big bang sounds and apparently flames coming out of right engine. plane was dipping .Captain said we had a few problems and need to land plane .2 hours later we landed in Iceland ,everyone was terrified .why has there not been anything on news or in paper .i have been looking into compensation etc but it seem to state you can`t claim if you landed in a non eu airport .would thomas cook have landed there on purpose ?how can i find out if it was caused by the problem in the first place and i would like people to know about this to stop them going through what we went through .my son says he will never fly again and i`m sure there are a lot more who feel the same

    On the face of it this IMO would be successfully defended by the airline as an unforeseen safety issue.

    I was wondering if I have any cause for compensation as I was delayed from Palma to Manchester with my wife and newborn in 2001.The delay was around 16 hours.

    A sorry tale indeed, but clearly out of time for this 'new' ruling.
    But you should have got some compo from your own travel insurance?

    Just read a few pages to understand what I need to do to make a claim. Centipede100 much useful info. Letter on way to Monarch for a 24 hour delay on return from Sharm el Sheik last November.
