Further to my post #1892 on page 95 I have finally received some info back from AA as to the cause of the delay I experienced on the BA flight they were running. I must say this is a new one on me so I'm not sure if it would be classed as extraordinary circumstances so they did't have to pay. I find it unbelievable rather than extraordinary
There is a form to fill out on AA's website that seems designed for insurance claims (hence the format of the reply that I got back) in case anyone else needs to know how to get this info from AA. Takes a while but it does come back eventuallyAA99/BA1540 19August2012 LHR ORD scheduled to depart London Heathrow Airport at 07:45 and scheduled to arrive Chicago O'Hare International Airport at 10:10.
However due to a power outage experienced at the crew hotel and because we require our crew fully rested in order to perform their duties effectively, the decision was made to delay Flight AA99. Due to this, Mr XX's itinerary was affected and he travelled instead on:
AA99/BA1540 19August2012 actually departing at 16:35 and actually arriving at 18:39.
I trust this information will suffice for your travel insurance claim. Should you require additional information please do not hesitate to contact me.
Now I have been in a hotel where we were evacuated because of a fire alarm and not experienced any significant loss of sleep. certainly nothing requiring an additional 8 hours of sleep. I can't imagine how a power failure could possibly require this level of delay if any. Any hotel I was in where I could not sleep in the room for the night I was booked in would be moving me to another hotel at their expense (done that before).
I'll be waiting for the 23rd October update before sending them my claim.

Claim is in (they have a specific web-form for 261/2004) and I have their physical address if a paper claim is needed.

Folks, just an update my correspondance with JET2.
Flight was delayed for 5 hours due to a technical fault, I know it was only 5 hours, but with 3 young kids being woken at 3 a.m. in the morning to catch a flight, and losing half a day on out holiday, I thought is was worth a shot.
I used the template which Centipede so kindly shared on the forum and sent it 20th July recorded delivery. I received a reponse from JET2 dated 27th September.
Firstly apologizing and confirming that the delay was due to operational reasons which prevented them departing on time.
They then go on to say:
"Having reviewed your comments regarding the EC261/2004 regulation, the administrative court ruled on 10 August 2010 that any and all claims brought by passengers for compensation for delayed flights under the Regulation are to be suspended, until the issue has been revisited by the ECJ (European Court Justice). We are therefore not prepared to deal with any claims for compensation in respect of a delay until the ECJ has clarified exactly what air carriers obligations under the Regulation. Only then, will we be in a position to consider claims brought by passengers, including (but no limited to) the Customer. We feel that this is a fair way of dealing with claims such as these, as it is in line with the Administrative Court's order dated 10th August 2010 whereby they stayed all proceedings relating to delay pursuant to the regulation."
I look forward to an update on the ruling at the end of October, when I can once again hit Jet2 with a claim.
They shouldn't be too affected because they "pride themselved on having a very high On Time Performance record" and want the opportunity to "restore your faith by demonstrating the usual high standards for which they are renowned".0 -

Hope someone can help because insurance company aren't!! Recently returned from a holiday in Lesvos and flight was delayed for 2 and half hours. The airway initially said due to Radar problems?? Arrived in Athens just as our connecting flight was leaving for UK. As we had booked we seperate airlines both said it was the others responsibility.....£800 each to return to UK and not sure what rights if any i have for compensation?0

You don't have any complaint against the international airline.
Check whether you can claim the standard delay compensation from the carrier between Lesvos and Athens, but if the problem was with the airport's radar system then you are on your own.0 -
This july I was in business trip to Malaysia. Returning from Kuala Lumpur to Belgrade (via Istanbul), my flight was delaying for more than 5 hours (instead 00:30, it departed at 05:35). Originally flight had Turkish Airlines flight number, but still it it was stated it will be operated by Malaysian Airlines. No clear explanation was given why this happened, just got voucher on cca 5 EUR for meal. Weather conditions were normal. This caused that I missed only connecting flight for Belgrade that day. Instead of going to hotel to wait for next day flight, I changed the flight in Istanbul to go to Sarajevo Airport in different country than the final destination, just to catch the home. I got home cca 12 hours later than I should, that caused postponing of my summer holiday at seaside with my family for one day.
Do I have any right for compensation? If yes, should I claim it from Malaysian or Turkish Airlines? Is there a specific form? I just find document of Malayisian Airlines, malaysiaairlines.com/content/dam/mas/master/en/pdf/book-plan/general_conditions_of_carriage.pdf
This documents says something on delay compensation, saying it takes effect on 1st September 2012 (my flight was in July). Also, there is no any claim form provided. Thank for the help in advance.0 -

Whether you are covered by the airlines Conditions of Carriage for delay compensation you will have to read and decide yourself but I would suspect not.
I understood that flights FROM an EU country were always covered. Not that it makes any difference to the person to whom you were replying, since Turkey is not part of the EU.0 -
ive just stumbled accross this thread and wonder of someone can give me any advice.......I flew to Turkey recently from Birmingham and 20 mins into the flight we were diverted to Munich because of a medical emergency onboard. unfortunately the gentleman concerned died on the runway at Munich. We were taken off the flight and left in Munich airport for 7 hours before flying on to turkey. Our duty free (purchased on the plane) was taken off us at Munich as we passed through departures again (no liquids above 100 allowed on the flight) I know I will be able to claim for the duty free (I have receipts) but am i due any compensation for the delay given it was a medical emergency??
