Compensation for delayed flights Discussion Area

I've just been informed that my flight that was scheduled to leave at 21.05 on Sat 6th Oct (tomorrow) has been delayed until 01.25 Sunday.
I was wondering if we would qualify for this compensation scheme, or if it only applies to delays once you have checked in (which would be 17.25 today)?
This delay has not yet been added to the online system, which is still showing the original departure time for our flight.
Just read the ruling again, and it does not mention anywhere about delays only after you have checked in, so I presume yes0 -

The issue will be how you wish to recover the compensation due i.e. one of the 3 methods I outlined in that previous post. The airlines won't suddenly all cave in just because claims start to flow through post 23/10. They will usually defend all claims quite rigourously and I would expect that to continue.
If you do proceed down the legal route I would expect a certain backlog of claims in the small claims track.
Thanks Centipede, I do intend to go all the way with this claim so ....
Just wondering though, I've seen your template letter as suggested, but should I go into the detail of the whole disruption? (obviously I'll need to add a bit about receipts that I'll have enclosed to be reimbursed). I have a lengthy description done for sending off to the travel insurance company, so was thinking of including that too. What do you think?
Also when you say 'I'll be proceeding with my claim' after 23rd October, will I need to do anything or does this just mean I'm asking them to deal with the claim thereafter?
When should I expect a reply from them?

Well said Moriarty - I just thought the same reading the post above...0 -

I am also guessing that the original flight was a Thomas Cook one which they contracted to another airline?
Many thanks Centipede ...will keep you posted as already had positive response re one leg of the journey, just need to pursue the other leg - absolute disaster of a "service".....0 -

You could always write to them asking for the details of for the delay
You could also state you will wait until the ECJ hearing before deciding what action to take0 -
Hi all,
We recently had a flight from London Stansted to Stuttgart in Germany with Germanwings delayed by 11 hours due to a faulty part on the plane.
I submitted an email requesting compensation and have received the below refusing it:
'In this present context we cannot offer you the compensation claimed and refer to several litigations at the European Court (C-581/10, C-629/10 and C-413/11). Even courts in Germany have suspended respective proceedings. Since there are reasonable doubts that compensation needs to be paid in case of a flight delay a payment has to be declined.'
Please could someone advise the best course of action and what the next step would be?
Thanks!0 -
Hi all
My flight from Nairobi to London with Kenya Airways was cancelled and rescheduled 13 hours later. Reading this, I don't think I can claim under the EU - but is there anything I can do?
We missed our flight up to Manchester - but the travel agent had booked this on a seperate ticket, so Kenya Airways wouldn't pay for that flight. We had to pay £150 to get home. I have travel insurance but confused by the wording (it says something like missed conncetions don't count if within UK and we were London - Manc, although coming from Kenya?). I'm applying for the refund of £150 - but will see what happens.
Am I entitled to anything else, is there anything else I should be doing?
Many thanks0 -

When were you notified? If the flight was cancelled and you were notified less than 2 weeks before your departure you may well be entitled to compensation (provided the cancellation was not due to extraordinary circumstances).
Unless your travel agent cleared it with you in advance that he would book your connection on a separate ticket I'd get another travel agent.0 -
Thanks for reply.
We were on the 20.40 flight Mombassa to Nairobi for the connecting 23.45 flight to London. We found out it was cancelled when we landed in Nairobi, even though they knew that it was cancelled before we even checked our bags at Mombassa. We were very annoyed that they didn't tell us earlier!! It was cancelled due to a strike.
Travel agent was Trailfinders. I can't remember if they mentioned it, but if they did then they certainly didn't explain the implications. I had no idea about the 2 bookings issue before now.0
