    What's the considered/expert opinion on time factor here when the judgement comes out.

    i.e. how far will claims potentially be allowed to go back to historically?

    I have two claims which I pursued at the time with the Airlines - one in June 2009 and other May 2010 but both airlines wouldn't budge even when I quoted the EU guidelines.

    I was planning to send them both letters based on #1676 and await the upcoming judgement.

    Any reasons why this mightn't be a good plan?
  • Have just come back from holidaying in Cuba and wondering what the situation is potentially with a claim.

    We sat on the tarmac for 2 hours plus waiting for a hydraulics fault to be corrected, we then took off. Apparently approximately 4 hours into the flight we turned back to Gatwick, but we were not informed until a couple of hours later. Landed at Gatwick, given overnight accommodation and the relevant food vouchers, given a sheet of paper detailing the information to claim from the insurers, obviously rather a small amount.

    We got to Cuba 26 hours late and it took us longer than usual to recover because of the stress and little sleep for a second night running, so really lost 2 days of our holiday.

    You may have seen this flight on the news, we were told it had been dumping hydraulic fluid over London and came in with smoking engines, met by fire engines etc. We were not told this by the company, we were told by someone on the flight back - this was a flight on 28th August through Thomas Cook.

    Just wondering where to go from here? Thank you

    Was the incident classified as a delay or a cancellation?
  • It was classified as a delay - they didn't want to give us our bags back but they were forced to as some wanted to jump ship so to speak.

    This is the first time I've needed to post in here and ask for some advice regarding a flight. ZB 743 - (Monarch) Malaga to Gatwick

    I have read some of the posts on here and not sure if my issue is worth perusing with Monarch and based on the information what would be the likely outcome.
    Having just had a lovely holiday, on Sunday we turned up for our flight home from Malaga to Gatwick. Monarch Flight ZB 743 that was scheduled to leave at 20:30.

    Upon checking in at the desk, did we notice our flight was giving a delay of around 35 minutes. We made our way through security and sat ready for the Gate to eventually be announced.

    After watching the monitors, our flight was delayed in futher increments of up to hour at a time. However no reason as to why the delay was given. There was one tannoy announcement to say that an update to the flight would be given in 55 minutes, however no further update was announced.

    It was only through communication to family at home did we know that the outbound flight from Gatwick was also servilely delayed so we knew that until that plane landed in Malaga would we be on our way.

    We eventually boarded the plane at 01:30, some 5 hours after the plane was meant to leave Malaga.

    We learnt from fellow passengers that we could get some vouchers offering food/drink. However what could you really buy at the Airport for 6 Euros, when most sandwiches or meals started at that price.

    When we finally boarded the plane, eventually the captain mentioned briefly of the delay, but no apology or explanation was given for the delay.

    I understand that flights are delayed from time to time, however the delay was not managed, there was no information given. Even on the flight back you though that they might give us a complementary drink but no we were still charged.

    An email from Monarch was received on the Monday morning giving a brief apology for the late departure of the flight, but no reason for the delay was given.

    I would appreciate any advice you may have please. They delay ruined a lovely holiday. If they knew the outbound flight from Gatwick was going to be delayed for that long did they not attempt to sort out another plane. ?

    Airlines generally do not have back-up planes waiting around to fly in case another plane gets delayed/goes tech. Is is also possible that nobody knew exactly how long the delay would be.
  • Thanks i have read that post , it would seem going it alone would be a lot of hassle , especially when the airline is used to this sort of issue and where i have no experience.

    We obviously did get home in the end , but it's the way they handled the situation or perhaps didn't.If we can get some money back for the delay we experienced then great. Every little helps.

    We did purchase food/drink ourselves, as it wasn't until later did we find out from a fellow passenger that we could get vouchers. This was not something that was freely advertised.

    First time poster and from what i've read there is some very good advice on here.

    Anyway I wonder if anyone could give their opinion on whether we can claim for flight delays or denied boarding:

    We were booked on the Thomas Cook TCX8032 (1435) out of Leeds/Bradford on Sunday 5th August flying to Tenerife. Boarding time and flight time came and went and we were advised there was a delay. Eventually we noticed that what looked like our plane had taken off without any of the Tenerife passangers. Thomas Cook notified us that 'due to severe disruption within the Thomas Cook Airlines flight program' we would be coached to Manchester, where our flight would leave at 2130. They did give us a £7 voucher each to use at the airport but as we all know this doesn't get you very far with three kids and two adults. So we had to go through LBA baggage collection and walk to the coach. By this time, about 1630, it was throwing it down outside and everyone got drenched lugging their bags from the terminal to the coach. We arrived in Manchester and the flight was roughly on-time and fine.

    Now whilst onboard before take-off, the pilot came out into the cabin to apolgise and advised us that our original plane had to be used elsewhere due to delays. We eventually arrived at our destination hotel at 4am, approximately eight hours later than planned, and missed an evening with meal from our holidays

    I have since investigated this and found that a plane spotting website had our original plane leaving LBA without any passengers on route to Newcastle at around 1425. Further entries on that forum suggested that due to an even longer delay with a Newcastle flight, TC Ops decided to abandon the LBA passengers in favour of some others.

    We were a party of eleven in three sub-parties consisting of six adults and five children and each party has either written to Thomas Cook directly or gone through the TC Customer Service portal online. Two of our party had a pretty generic letter stating that TC are not liable due to them not recognising and fighting the recent right to claim by passengers. The other had a similar letter from TC HQ stating they were not liable for any compensation.

    So given the above, does anyone know if we are due some compensation and would it be for denied boarding or just delay ?
