    When it's an individual taking action against a company the hearing can be moved to the court nearest to the individual. Get them to come to you!

    Oh thank god for that then as there's one where we live in S!!!!horpe! How do I request this?

    Well I think their conditional free flights offer was signed for by me as full and final settlement but I was at East Midlands with crying children and wife and furious mother in law and wasn't told that this was in lieu of my rights under the ECJ ruling so maybe this is their defence. Once I was on holiday I read the letter and realised that the condition of travelling off peak meant only the mother in law could go anywhere as we can't legally take the kids out of school and I presumed off peak would not include any school holiday.

    I emailed Jet2 about this:

    "Hello Jet2

    We were not allowed to fly on this flight because the plane was too small and we were among the ten passengers taken out of the check-in queue

    Having now returned home last night at 10pm I am trying to understand our rights. In the letter we were given at EMA it says that each of us has "one off-peak* free of charge return flight" but there is no footnote matching the asterisk to explain what off-peak means

    As two of our party are our young children aged 3 and 7 if this precludes travelling during school holidays then we will not be able to take this up as taking the 7 year old out of school during term time is illegal

    Please could you advise me as to what your letter means for us in these circumstances

    *Booking reference of the flight relating to the Free of Charge Flight Voucher

    *Three date requests to use the Free of Charge Flight Voucher, please put these in order of preference including the outbound and inbound dates if a return flight.

    Example:
    Preference 1
    OUTBOUND: Leeds to Malaga - 25th March 2012
    INBOUND: Malaga to Leeds - 30th March 2012

    Once we have received this information we will check availability and advise you as soon as possible.

    which didn't explain the point I asked about. Then I posted on here and have taken the action I've told you about

    I know that what we were not told was that the alternative to their free flights offer was EUR400 compensation for each of us payable there and then. They said because we were a family with young children we were a priority so they would fly us out from Newcastle and to sign for the free flights and then they bundled us off to the taxi rank. So I did not have time to read the entire text or any small print because all I was focussed on was getting the five of us up to Newcastle and away on our holiday. It was all very chaotic and hurried. We were grateful and thought they were being nice to us. If we had a clear choice between flights we cannot use and EUR400 I know which we would have chosen there and then in the airport - the compensation to spend on the imminent holiday

    If that's their defense it's BS for the reasons Centipede mentions. Good luck though I don't think you'll need it, I'd be shocked if a judge doesn't rule in your favour based on what you've told.
  • Just got a letter by recorded delivery 5 mins ago. It's from Jet2 offering £1636.00 in full and final settlement of our claim

    Apparently they "discussed this matter internally"

    Looks like they don't want to come to Scun-thorpe County Court after all

  • when coming back from tampa to gatwick with ba in july my flight was delayed by 24 hours , they said at the airport it was due to too much traffic landing at gatwick due to the olmpics but when i got on the plane they said it was due to a bird strike
    i was put up in a hotel with vouchers for meals which did not cover the costs i always had to pay some extra for the meals
    can i claim for the delay ? if so how
    dont think i can but through i would ask

    Brilliant news. But it is still not acceptable that Jet2 made you jump through hoops before they did what the law required them to do.
