I'm now at the stage where we have been repeatedly refused comp by Vueling and have had confirmation today that they have no UK address at all.
I've been looking into using the Spanish ADR but wonder if that is the best course of action. Vauban's guide 5.12 indicates that going though the CAA may not be useful so I'm wondering if it is worth trying the ADR route before we resort to a NWNF outfit.
Having read the guide I know that taking them to small claims myself is not something that I would be capable of.
I have a NBA ready to post to their Barcelona office but am unsure if I should do that first or attempt ADR.
Can anyone advise me please?
P.S. DH told me last night that on the delayed flight, the crew made a couple of announcements about waiting for passengers and that backs up my recollection of people getting on and off and headcounts etc. So for them to claim ATC reasons is a joke. They probably lost their slot and had to wait but it looks to have been poor management if anything.
They may have missed their ATC slot due to the additional head counts, so any later ATC delays are only a consequence of the original delay, not the cause.
ADR is a good alternative way forwards if they use one.

Yes, if there is one, it doesn't appear to be on the CAA website so I'm not sure if or who they are. Nothing you do at ADR will later prevent you from attempting a different approach, plus it's free usually.

I found this site which says it is a totally free service and covers Spain along with other countries in the EU so it may help someone.

Unfortunately having looked into it in more detail I think you're right Tyzap. Vueling isn't a member so I can't use them.

I will be lodging our claims with Bott &Co today. Nothing to lose at this stage.

Having looked at this for you Rosie I have to say I agree with the advice from Tyzap. It doesn’t appear you can use ADR either.
This is just two difficult to take on via the ESCP and in view of the fact that this first leg of the flight did not delay over the required hours to be a valid claim, I have to be honest and say I’m not hopeful for you but I do understand the hurt and upset this delay caused you.
You can put your delay through Botts calculator and see if that indicates a valid claim. But I’d 100% leave this to a NWNF Solicitor IF they will take the case on.

HI, I booked my family of 5 to go from London to Malaga with Iberia as Iberia were offering the tickets cheaper if we went via Madrid. They offered 1hr 45 in Madrid to connect and I assumed that this would be plenty - I've never taken a connection before but assumed it was fairly straightforward.
In the event our flight to Madrid was delayed by 45 minutes and on arriving at the gate (running!) in Madrid they told us that even thought the flight hadn't taken off, we wouldn't be able to get on as our luggage hadn't been moved.
After a few hours of queuing at the help desk, we were offered a flight 30 hours later and accommodation, or the option of taking a train. We did this, scrambling across Madrid to catch the train and we ended up in Malaga 4 hours later than planned.
My question is this - because we accepted the train tickets, should we take this as our compensation, or can we still make a claim for arriving 4 hours late?
I've searched elsewhere and on Vauban's guide but can't quite find the answer - sorry if I've missed it.

whether any compensation is due will depend on the reason for the 45 minute delay from London0

It depends on the reason for the flight delay to Madrid. If this was not a valid EC then you have a claim for compensation for the whole distance of the journey as it was over 3 hors to get to your original destination.
The should alos be able to claim any additional receipted expenses you incurred such as taxis, food and non alcohol drink.
