  • This is interesting because your claim should be based on simple breach of contract. There was a collateral contract between you and the airline. Two months is far too long to wait. You should send a 7 day NBA now and if they don't pay, sue them under the collateral contract, not under the regulations. Remember to claim interest


    Am I able to claim costs (solicitors) if I go down this route or do have to bear those? The advice seems to point at Bott and Co so Im thinking that is who I will contact if I don't hear anything. I am a complete newbie at this sort of thing so thanks for any advice.

    If the airline is being cagey about the actual details regarding your cancellation, they are probably giving you the brush off.
    Ask for a timeline of the full details of what happened.

  • Sicleaver. Recovery of Costs in small claims cases is very limited. If you do it yourself it will be limited to Court fees and expenses. But that shouldn't put you off.
  • Hi, I was recently delayed on a flight from Manchester to Newquay with Flybe. The flight arrived about 4 hours late so I filed a compensation claim and I received an email saying I am entitled to €250. The next day I rang Flybe to confirm card details etc and during the call I was told the payment couldn’t be proceeded as there was an investigation underway. Then, I received an email stating I am no longer entitled to the money, despite previous emails (which they told me were not legally binding), as the flight delay was 2hr 45 min delayed after technical fault then a further hour due to weather.

    Is there anything I can do about this? I arrived 4 hours late and was even given confirmation I would be receiving compensation.

    Put your flight details into a couple of online flight delay calculators such as this one at Botts.

    That will tell you if you have a valid claim.

  • I'd be pushing this because it could be argued that if there hadn't been the technical problem in the first place, the flight might have arrived before the bad weather took over.

    I'm looking for some advice (apologies if this has been asked before, I have tried searching previous forums, but couldn't find what I was looking for).

    I have recently had a flight delay of over 30 hours. I believe I am entitled to flight compensation under EU ruling, which I will put in a claim for. However, my question is: if you apply for flight compensation through EU ruling, can you also claim late departure through your travel insurance, or is it one or another?

  • I phoned yesterday to remind them - I actually got an apology for the first time and it was escalated to a team lead for allocation to someone to review.I received this today. Interested to see how long it takes to progress in their accounts section.

  • Hello,
    I wonder if anybody can help. I was recently on a TUI flight from Glasgow to Naples. The flight was delayed for 27 hours, it was due to leave at 06:10 and at 10:30 we were told the flight had been rescheduled until 08:50 the following day!
    I can only see that we wpuld be due £360 compensation each, am I correct in thinking this or is there more that I could claim. They did put us up in a hotel ovetnight and fed us but we still lost a big chuck of our weeks holiday!
