No you are not entitled to more unfortunately. The EU regs do not provide compensation for delays as such, only for those arising out of cancellation or over-booking.

So in your opinion this is a delay rather than a cancellation? Could not Flashwoodgaz have in these circumstances demanded from the airline to be provided with meals, refreshments and insisted upon being placed in hotel accommodation per EC 261/2004 for the duration of the delay?
Is is not one or the other-either a delay or a cancellation?
What then is the status of a "rescheduling" within EC 261/2004 as I am trying to find mention of it within EC 261/2004 . Perhaps you could point me to the particular Article within the Regulation? I only ask as you seem to be an authority on the application of this law.
  • I flew with Ryanair flight was scheduled to leave in the afternoon yesterday but set off 6 whole hours later from dublin. Checking google there was a radar failure at the airport that morning but should have cleared up by the time of my flight and wasn't. We even had to wait for the plane to arrive in from london.

The flight got set back with three delays 9.55pm 10.55pm then 11.20pm. I think Ryanair had planned rally badly to get the planes around and didn't even bother with it's customers.

Just wondering if you think we would be able to put a claim in. We was stranded at the arrival airport too as we planned for public transport and arived after midinight :(

They only provided limited info before boarding the plane and also on the plane and no offer of free drinks or meals had to buy them constant queue at the bar.
  • Hi everyone,

My fiancee and I have just endured a nightmare trip home from Katowica in Poland with Wizz Air.

We arrived on Sunday 15th June for a midday flight to Liverpool with a 10 min delay on the board. Once in departures this 10 min delayed grew by 15mins, 30mins and an hour at a time, 8 hours later we eventually heard that the flight was cancelled due to “operational reasons”.

Now I have no doubt they had no intention of flying us anywhere on Sunday and made everyone sit there long enough so you changed your flight plans of your own accord thus freeing Wizz Air of any responsibility.

After queuing again for over an hour, the one customer service rep just shrugged his shoulders and said he could give me a flight the next day to Luton 6am, Stansted 5pm or Doncaster 8pm. The only viable option being Luton was taken but that still left my car sitting at Liverpool airport with my home in Stoke-on-Trent. No mention of our rights were mentioned at any time.

My question is where do we stand legally? I didn’t require a hotel as my fianc!es parents live close and put us up but I am very angry at the way Wizz Air treated us.

I have been told as the cancelled the flight for operational reasons we should be due 400 Euros compensation each? Is this right?

The cost of getting from Luton to Liverpool to get my car cost £120 for the 2 of us, more than the bloody flights, I want this reimbursed too. Is this possible?

We both will have to take a days holiday or lose a days wages. Where do we stand with this?

Thanking you all for you help.

Keep all your boarding passes etc,do you think you have any claim also on your travel insurance? Beware that if you get anything it is likely to be vouchers (in my case off a long haul flight i was never likely to make again) and i sold them on ebay. You should have also asked them for meal vouchers for the delay plus access to phone fax etc.they won't tell you,but over 4 hours delay in general you were entitled but can't claim them retrospectively.
  • The Wizz Air staff proudly announced that after a delay of 3 and a half hours they were supplying "lunch boxes" for all passengers.

This lunch box consisted of 2 chocolete waffer bars and a 25cl carton of watered orange juice. My fiancee told me the chocolete bars sell for 15p in the shops and the orange for 20p locally. Not my idea of a meal and no mention was made of phone calls.

Wizz Air either say to make a claim to call their premium phone line at 65p per min or email, then say they take 4-weeks to answer emails.

Sounds like the start of the runaround to make it as difficult as possible to me.

We had the mispleasure of suffering a horrendous 25 hour (yes 25!!!0 hour delay on this flight.

Save for the fact the the LGW-MCO route is the worst performing one on Virgin's schedule, this took the biscuit.

When we finally boarded the plane some 25 (yes 25!!) hours late we were all given a letter saying that we could all 25,000 air miles (per adult, 15,000) for kids over 2).

    What an insult.

This would not give us one maybe two in the sale reward flgiths that you can never use during school holidays and which are still subject to some £340 tax per ticket.

What else can we do? I am a Gold card holder with Virgin's Flying club and frnakly after this I am transferring back to BA!

A delayed flight becomes cancelled if they change the Flight Code (Flight Number). It is then considered to be a new flight. This would for example happen if they put you on a codeshare flight with another airline or aircraft.
Codeshare flights are recognised by a 4 figure flight number (XX 1234 or XX 123a) against the standard 3 figure flight number(XX 123)

Do you know where this rule is? My flight was VS 028 and whilst delayed 25 hours was called VS128 when we took off as they had another VS 29 leaving that day
