    I don't have at this moment a question about delayed flights but have bood direct flights from Edinburgh to New York return and just received an e-mail saying the return flight has been cancelled and the alternatives offered are the same flight but next dya (which I cannot take) or indirect flight transfering in Paris onto Edinburgh. As I have paid for direct flights what sort of compensation can I ask for, or what freebies can I ask for e.g flight upgrade. Is this possible to do
    Any reply would be greatly appreciated

    The flight was from Toronto, Canada to London Heathrow and the flight was delayed by over 4 hours but they are saying that as they aren't an EU carrier they don't have to give us anything.

    Hi,

    I would like to respond to Shona99. She is completely correct with your statement that only UK sollicitors can send a summons in the UK. We, EUclaim, cannot. We have engaged with the Dublin/London based law firm Lavelle Coleman to do this on our behalf.

    EUclaim posseses a large unique databse that in many cases can clearly show that arguments from airlines why the refuse to pay compensation under Regulation 261/2004 are false. This combined with our in-depth knowledge of the Regulation and other legislation like the Convention of Montreal has resulted in succes in thousands of cases. All, without having to go to court once. This also surprised ourselves. Of course we do and will threaten to send a summons. But we hardly ever have to.

    We also provide our database base knowledge to Legal Aid insurance companies and indepent sollicitors. WE are even contemnplating a service where privite citizens can acces our database, but that plan needs further development.

    So do you need a UK sollicotor? Yes, and we will provide on our own expense. Do you always need advice from companies like us. Hell no, if you have clear evidence don't spend money and do it yourself. But in real life that take perseverance, time and sometimes money. Look at it as filling out your tax return forms. You can do it yourself or you ask an accountant. The choice is entirely up to each individual.

    Can I maybe asked that MSE users are offered a discounted rate of 15% for your services? That would be a great offer.

    I am in the midst of a discussion with Virgin over a flight from Orlando on June 1. Its being discussed on Flight Mole. They are telling me the flight was delayed for 25 hours which is bonkers even though it had a different flight number etc. They are also saying a technical fault is NOT a compensation event.

    So I have four family members entitled to 600 euros each. Thats not a bad pay day for you or me! So shall we agree on 15 percent mates rates??

    I do not believe that matters. Looking at EUClaim they have dealt with American Airlines so I would continue to pursue the airline for your dosh

    Well they are wrong. It applies to EU airlines, plus any flight starting or ending in the EU.

    It's possible that they could plead 'extraordinary circumstances' though - with a full cancellation they would certainly try it on. Whether it applies to overbooking (in this case really a part-cancellation rather than deliberate overbooking gone wrong) I don't know.

    Hendrick-I think-has clarified an important point here to my satisfaction at least-effectively that EU Claims are prepared to invest in sponsoring litigation by using Solicitors as part of the service they offer to passengers. I'm not sure who else here is willing to step up to the mark as they are prepared to do-other than individuals passengers-who he correctly points out they can do this themselves-should these passengers themselves invest the necessary time, energy and make similar risks themselves.

    This investment might have attendant risks and costs and those risks should be rewarded. especially if no-one else is offering a comparable service.

    Presumably EU Claims has incorporated the costs of those risks and indeed the cost of such sponsorship of litigation in the cost of the service they charge and I personally could quite understand why EU Claims would not feel amenable to negotiating this cost when these factors are considered.

    Everything is negotiable.

    Depends if they want the business or offer MSE a better rate.

    Hendrik, as he wanted to, spoke on behalf of his company.

    He may well decide that is prudent business to offer MSE a better deal as many other companies do on other forums.

    I was under the impression that this was a place to save money and try and do the same. By getting a better deal then we are all saving money for those that want to use his service.

    As everyone has said, we could bring the claims ourselves. Heck I am a Solicitor so could bring it myself. But I may decide to use EU Claims.
