TenThirteen,
Please accept my profound apologies for my carelessness in regard to your gender. Absolutely no offence was intended: my attention was more focussed on the opinion you were advancing.TenThirteen wrote: »
.....They should get the letter this morning so will probably open it and ring me in about six days!! :rotfl:
My comment in response to that was not a suggestion that The Mobile Outlet would fail to open your Letter Before Action; it was an expression of my considerable surprise that, after studying this thread and the two that preceded it, you could actually think that your Letter Before Action would prompt The Mobile Outlet to telephone you at all.0 -
kltpzyxm,
It's worrying that nobody owed money by The Mobile Outlet now knows from what address it is actually trading...0 -
Hi Everyone,
<snip> I think they are playing a trick by stating that they did not receive the dispatch note. Can anyone tell me as to how to prove that I had included the dispatch note in the documents that I sent?? now What should I do to get the cashback??
Note: I have the copy of all the documents that I had sent to them.
Thanks,
Samson
It is impossible to prove what you have already sent
Write them pointing out their 'Oversight'
Read the 1st page of this thread (Post#7) if you get no joy from your letter. :AWell life is harsh, hug me don't reject me.0 -

MOBILE OUTLET HAVE REFUSED TO PAY OUR REMAINING CASHBACK even after court threats. They say if we want to appeal again to this we should do but I dont think its going to get us anywhere therefore we will be taking them to small claims court. Should we write again letting them know that we will be or just leave it at the previous threats?teenage_Drama wrote: »Hi
We have just received a letter from mobile outlet about our 12 months free contract (nokia 6103).
''Part of the conditions given to you on your purchase with the mobile outlet, was that you were entitled to a cash-back offer. This was available by forwarding your original dispatch note and required bills within the specified timescale. We have received all the bills however you omitted to send us your original despatch note or welcome letter. Your despatch note will have come from either our despatch company, Dextra Solutions, or from ourselves at The Mobile Outlet.
As you have not included your original despatch note, your application for cashback has been rejected.
If you would like to query or dispute any of the information given in this letter, please do so in writing. Cashback claims will only be reveiwed if a request in writing is received. We are not able to review any cash back claims via the telephone.
Kind Regards
Customer Relations Manager''
My mum sent in papers for her cashback 31st may via recorded delivery, they took 28 days to process it 30th July, now if I had been informed in the 28 days that they had not received my dispatch note (which was not sent out due to false instructions from the staff which they kept telling me to write my details on a piece of paper and nothing about the despatch note). If i had been informed in those 28 days I would have sent it in but NO they decide to send it to me on the 14/7/07 so I receive it today (17/7/07) so now we are losing out on ALL of our cashback which means we have just lost our £420!!
Spoke to member of staff who told us to write an appeal & send the despatch note with it!
Just writing a letter to mobile outlet and dont know what to say, should we say we had included the despatch note (not a good lie is it) or mention the false instructions etc and their sneaky ways of scamming people.
Could somebody help us add things to this letter, will be giving court threats, anything else?!Any help would be kindly appreciated

Yes, it's only since the new t's & c's came out.
I guess that the new address is their new premises.(edit: The new address is a P.O. Box number) They haven't notified old customers of the new address. I guess that they will be using this as a reason for cashback letters going astray anytime soon.Well life is harsh, hug me don't reject me.0 -
<snip>In point of fact there has never been anything in The Mobile Outlet's posted Terms & Conditions prior to August 2007 that would actually prevent them legally from making four instalment payments of 1p and paying the rest of the cashback in one large, fifth instalment after twelve months.
<snip>
I bet the Mobile Outlet have noted this and is included in their new draft t's & c's (Dec 2008?)Well life is harsh, hug me don't reject me.0 -

I was referring to the new address in the revised T&C. Like you, I haven't been notified by TMO of a change of the cashback claim address, and I agree with thesaint's post that this is likely to be the next tactic to be employed by TMO as an excuse to refuse cashbacks that have gone astray...0 -
