thats funny...anyway i just checked the status of my order, and my phone has been dispatched, i thought they email you to notify you, but oh well, so i shall be expecting my shiny k810i tommorow.
As per the t&c's on their website, we have 28 days to send the cashback forms, if we do not it invalidates all our other cashbacks, cant we force them to pay us our full cashback if we do not recieve it in 45days, because they have written that on their website, how come we have to suffer even if we follow the t&c's and they can break their own t&c's.0 -

1st cashback history;
claim received 13th june
email received mid july promising payment within 10-14 working days
email received late july confirming acceptance and receipt - payment within 10-14 working days
letter before action received monday 6th august asking for entire 12 months payment
telephone enquiry from myself yesterday 'wait another 10-14 working days due to backlog'
5 chasing emails sent in total
They have until the timeframe given on the letter before action and then im filing the small claims action. ive had enuff of this muppset outfit and their constant '10-14 working days'. It'll be 2 months since they've had my cashback claim when I file the small claims.0 -
Thanks for your responses, still no word from MO but a fact to remember here is that MO have defaulted on the contract my not sending the (abeit erroneously completed) cheque to me on time... what's the point of a contract if they're going to do whatever they want!?! You can be sure that if any of their customers put a proverbial foot out of line they'd be denied cash back from it. Is it too much to ask for a company to abide by their terms and conditions??If this is your understanding of how The Mobile Outlet operates, you indeed need to work more on your lurking. A great deal more.
As the owner of a small business myself I believe that any company who receives a recorded delivery letter clearly marked 'Letter Before Action' would open it within a week... or maybe that's me making another 'mistake.' ??
My MO contracts' T&C's do not make any reference to five payments i.e. the supposed £84 value of the cheque I received. If this is the way they do things surely they should have it mentioned in some correspondance with me?? Even a note sent with the cheque, instead it was just a badly written cheque alone in an envelope!!
Re: saying I never received the cheque... I was told twice that I would receive my cash back my BACS so I wasn't even expecting one!!
All I know is that I followed their cash back terms 'to the letter' and all I expected was them to honour their part of it (specifically re: the time taken to issue cash back cheques or BACS.) I still believe MO have defaulted on the terms of out contract (I wouldn't treat my customers like this!!) although I'm still waiting to hear anything from them before I proceed with a claim...writing a cheque with differing amounts in words and numbers is not always (nor even often) an innocent mistake arising from human error - it’s one of the oldest tricks in the book for delaying payment of a debt.
Yup.The recipient of a late payment by useless cheque should return the cheque with a Letter Before Action, giving 7 days to rectify the error.
... Well making some contact with me rather than automated emails referring to 'server delays' would be a start... they haven't replied to my emails about the erroneous cheque and have (to date) made no offer to rectify their error... so still I wait!!

Went ahead and ordered one of the two phones we need late last night. Quidco tracked fine. By 9.30am dispatch was confirmed, so delivery should be tomorrow. Great service so far. Just hope, like over the last year, I get all my cashback0
