    Well just in case the mobile outlet are reading may I take the opportunity to say the following;

    - You have seen fit to deny my whole cashback despite me complying with the T's & C's as you "didn't recieve the dispatch note" despite me sending it AND supplying 2 subsequent photocopies AND a fax when requested to do so.
    - You ignore and fail to reply to 8 of the 10 emails sent to you. Instead you write to request another copy of dispatch note, then write to say it's arrived after the claim period, despite your letter of request being sent after the claim period. (What a pointless excercise).
    - Your customer service call centre promises call backs in regard to the query (as post and email got us nowhere) but never call back.

    All in all your service has been proven to me to be shockingly bad, especially in comparison to my partners cashback claim with onestopphoneshop which could not have been easier.

    Furthermore discussion with work colleagues about this matter now means that none of my work colleagues (and by extension the family & friends they talk to) are willing to buy from you. Which by my guess in the last 6 months has seen approximately 50-70 people take out contract phones but deliberately avoid the mobile outlet due to knowledge of the service you have failed to give me (as well as being referred to this thread).

    So, even if I never do get the cashback you've falsely denied I'm glad to say it will have cost you far more in lost business.

    To one and all; The mobile outlet, caveat emptor!

    I agree, onestopphoneshop are much more organised, once you send the documents off, you recieve the cheque in 3 weeks,and you can even track it on their website, is shows when they recievd the documents, whether is has been verified, and whether it has been sent off. I decided to go with MO for my new contract becuase its a good deal, but its been a week, and the tracker is saying 'Allocating Stock' as it has been for 6days, called them today, and i should expect delivery in another week as the phone was out of stock, hmm so they should wirte on their website, 'can take upto 2 weeks to reciev phone'. Onestop... sent mine same day, got it next day. Come on MO you need to improve your service, there has been almostt a 1000 posts complaining about your service...:mad:

    Which phone did you order? Might be placing an order soon, and just wondered which one I should avoid :)

    Obviously it's your choice etc but if I can offer you one piece of free advice; While you've not recieved your phone I believe you do not have a contract with them as yet.
    SO, might be better off in long run to call now and cancel stating the reason as they cannot provide stock in the timeframe agreed.
    Giving you the freedom to shop elsewhere.
    OK, the deal may not be as sweet, but the TMO deal is only sweet if they actually pay up. Otherwise it's an expensive mistake. You yourself have pointed out there is 1000 posts of complaint about them, if that isn't a big sign to avoid them I don't know what is!

    Here is how my 1st cashback claim went:

    05/06/07 Sent bills 1-3 with SAE by Special Delivery
    05/07/07 Reminder email sent to TMO. Received automated reply about delay
    16/07/07 Received document acknowledgment email and cashback accepted email
    06/08/07 Cheque received


    A month late but at least it was paid!

    It’s not, after all, the sort of motto you’d want to see engraved on a plinth facing the pilot of any aircraft you’re flying in and not quite the maxim you’d hope would be the abiding philosophy of the surgeons in any operating theatre you might find yourself being wheeled into.

    More like what you’d expect to see written on a plaque above Wally Bush’s fireplace.

    The Chancery Division is replete with those who enjoy an indulgent lifestyle founded upon ardent knowledge of the laws of negligence and fuelled by an over-abundance of those possessed of the innocent view that mistakes are universally permissible.

    But before anybody gets grumpy or mad< and starts weighing in with the rule book to complain that this is off-topic, let me make it clear that my expressed concern arose from the potential consequences of your advancing that remark in the context of The Mobile Outlet.

    I don’t imagine the words ”Everyone is allowed to make a mistake” are prominently emblazoned on the wall of the cashback adjudicators of The Mobile Outlet.

    To submit a cashback claim late would not be an allowable mistake under a contract in which strict adherence to dates is fundamental - as you, yourself, have often (and rightly) pointed out in this thread - any more than would be late payment of a cashback instalment by a retailer. The courts do not countenance either.

    It’s also worth bearing in mind that writing a cheque with differing amounts in words and numbers is not always (nor even often) an innocent mistake arising from human error - it’s one of the oldest tricks in the book for delaying payment of a debt.

    Not, of course, that The Mobile Outlet would ever stoop to such practices, given its passionate commitment to providing “outstanding customer service”. http://www.themobileoutlet.co.uk/aboutus.asp

    I haven’t, incidentally, been avoiding participation in this debate (nor even lurking). I’ve been abroad. You would otherwise have been enjoying my strong support for all the wise counsel you have posted on here - which I hope you will continue to do.

    No worries.

    The "mistake" over drawing the cheque would be seen as an error in court.

    But a court case shouldn't be over whether or not the Defendant made a human error.

    The recipient of a late payment by useless cheque should return the cheque with a Letter Before Action, giving 7 days to rectify the error.

    The ensuing case would concentrate on the breach of contract, not the mistake!

    In regard to The Mobile Outlet's new T&Cs, incidentally, one part that amuses me is this:

    11.1 ..... Simply send each voucher in numbered sequence order on each Instalment Date and send it to us with a bill evidencing that you have been connected for the periods set out in clause 11.2 if you have a 12 month contract or clause 11.3 if you have an 18 month contract at the address below

    GunJack's regular update - cb#3 of 5......

    Ey up all...well, after a lousy week in the GunJack household, what with NOT moving house (as it turned out to be a bit of a dog) and being inpromptu laid up in hospital for a week, I have come home and checked out my progress(or lack of ) with cb#3. It is now 16 days since TMO e-mailed me to confirm my claim was successful and to allow 10-14 days for BACS payment. It still isn't here, so nice polite e-mail chaser sent to TMO to give them a prod.

    cb#3 of 5 is now on day 37 overall, so if it comes the next day or two it will still be the quickest cb so far.

    Here's hoping........:rolleyes:

    I ordered the K810i on 10 months free on a 12 month contract on Flext 35, its a fantastic deal. And when i called today they said they should get it in stock today or tommorow, so hopefully i should ge it by monday. On the cashback issue, most of the people who complained on this thread and the other one, managed to recieve their cashback after a little hassle, and so it seems that TMO have improved quite a bit since the orignal thread started...i can wait 2 months for my cashback. I had succesful cashbacks from e2save, phones4u, and onestop...., so hopefully i can look forward to enjoying another almost free contract. :T

    Yeah, we are just coming to the end of two contracts with them (full 12 months free contracts) and not had any major problems. So, I think we are going to give them the benfit of the doubt and go for two more now.
