Today is day 17 of cb#3, and as yet I don't have anything back from TMO. Too early to chase up yet, though.....

Not according to The Mobile Outlet, they posted this on MSE 8 months ago.
    Hi,

We have upgraded our cash back system to allow for speedier processing of all cash back claims. The benefit of this system which poppy9 has already experienced, includes an email to confirm the receipt of your claim and another email detailing the result once it has been processed. These updates should be recevied by customers within 7-10 days from the date your claim was received by The Mobile Outlet. Payments will continue to be paid within 28 days of receipt. This system has been designed in mind to ensure customers are kept upto date with the progress of their cash back claims - an area where members of this forum have suggested needed some imporvement.

Everyone has been getting these, right.

    Hello,

This morning I have received a cheque from Mobile Outlet for cashback 4/5!

The claim was received by them on 20th June, which makes it 28 days since they received the claim to dispatch of the cheque. Don't know why they have sent me a cheque as they paid me by BACS last time, and I did not fall into the band of time where the server issues prevented any BACS payments, but I'm just pleased to receive it. Of course, it could be a cynical ploy to delay the money going out of their bank account because the cheque will take time to clear - but lets look on the positive side eh? It was almost on time.:T

I'm just awaiting cashback 5/5 now which was received by them on 16th July.

Hi - in my experience delays from the Mobile Outlet are getting a lot worse.
Cashback 4/5 submitted 17 May, acknowledged by email 19 June promising payment within 7-10 days and still no payment confirmation email or payment.

The previous one - 3/5 - was sent 20 March, acknowledged 20 April, confirmation of payment email sent 3 May with payment by BACS on 8 May.

They seem pretty desperate not to pay out at the moment. Claim 4/5 is ready to be sent off.
I'm now in the 12th. and last month of my contract with only 2 payments received so far.

saint - I hear where you're coming from, but I will probably wait until day 21 before chasing up. After my e-mail chasing up cb#2 left them in no doubt that I would take it further (but was done nicely :D ) they paid up okay, so I feel a similar approach may well be in order for cb#3, but from day 21. We'll see, and I will also monitor other's progress (or lack of) on here and elsewhere.

  • Hey everyone,

I was on an old deal with the mobile outlet where I received cashback in just 2 instalments. The first was paid after sending the first 6 bills after 21 days of receiving the 6th, the second was paid after sending the last two. The wording for the second was deliberately ambiguous:

"To claim the second half of your cashback entitlement, forward us your 11 and 12 months bill, again this must be with 21 days from the date shown on each of these bills."

The word again is misleading because it is different from the terms for the 1st one. I sent both together within 21 days of the 12th and was told I failed their T&C's as a consequence. Has anyone else had this experience with these terms, and anyone fought them successfully for being deliberately mis-leading? I wish I'd found this before as it would have fore-warned me of my mistake :-(!!

Also, I notice in their T&Cs they use the word "with" and not "within" - does this slip of theirs help me at all?

Any help or advice would be much appreciated!! :-).

    All the best,

    Jamie

It has been posted previously that this would fall foul of this policy.
    The plain language requirement
According to the UTCCRs, a standard term must be expressed in plain and intelligible language. A term is open to challenge if it could put you at a disadvantage because you are not clear about its meaning - even if its meaning could be worked out by a lawyer. If there is doubt as to what a term means, the meaning most favourable to the consumer will apply.

I can't remember if anyone has sucessfully used this through the courts though.

I wasn't suggesting you chase them yet, just letting you, and anyone else interested that The Mobile Outlet have stated that they would be sending out e-mail updates when they receive claims and another once processed. :A

saint - thanks for the reminder. I personally have been with this thread since it was the old thread, if you see what I mean, however your as ever valued input should help out some of the newbees with this company.

Personally I will be looking for a "fire and forget" cashback company next time round (when mrs GunJack's current ctt phone is up) rather than go with a company that takes so much chasing again......

GunJack - fed up of chasing what's rightfully mine :D

Has anyone successfully taken TMO to small claims? They really are ripping me off I know I have abided by T&C's
    It pays to challenge
