Hi Guys i need help.
I have been asked for a despatch note which i may not have had at the outset.Could someone email me a copy and i can alter the relevant details to mine.Would this be easy enough. "holding breath" Thanks.

junkie - you are inferring in your post that the t&c's have changed at least twice recently. I'm on cb#3 claim, but my initial one needed the dispatch note, as did brenda , ktl, etc. Therefore, they must have dropped the requirement to send the dispatch note between last September-ish and re-instated it around now. Is this what you meant ? I am just concerned that any relatively new customers reading your post may be unintentionally misled.
To everyone - ensure you check the requirements as stated in the t&c's applicable when you took your contract out, in order to follow the correct claims procedure and send in the correct documents, ESPECIALLY for your first claim.

Hi,
I was wondering if you kind people can help me at all.
I have a 12 month free contract with the MO and have successfully claimed the first two stages of cashback with them, the second stage was paid 4 weeks later than promised!
I had to go away for a few months to attend to a sick relative and have missed the deadline for stage 3 of my claim(deadline 30/06).
I was wondering have I lost the remaining cashback or is there anything else at all I can do?

I am going to e-mail the forum queries people and was wondering if this letter is ok to send:
Dear Sir/ Madam,
I have a query regarding my cashback claim, the details of which can be found at the bottom of this letter. Due to a member of my family becoming ill I have been abroad for the last 2 months. This has meant that I have been unable to submit my claim for stage 3 of my cashback claim. This is for months May-June. I appreciate that I will not be able to claim for stage 3 of the claim but will I still be able to claim for stages 4 and 5 of the claim, considering my situation?
I am aware that your T&C’s state:
‘If any one stage is not complied with, you will loose your entitlement to claim the whole of the cash back’
However your company have already broken the T&C’s because my second cashback was paid approximately four weeks after the 28 day limit. As I was away I was unable to deal with the late payment as I was busy attending to my sick relative.
The T&C’s state for the above:
‘Once we are receipt of your original documentation, please allow 28 days for delivery of cheques.’
I hope the above can be dealt with amicably and I hope to hear from one of your team members very soon.

tada - worth a try, but as you didn't get a court judgement over the delay in cb#2, I doubt if you have any recourse now having missed the deadline for cb#3. I would think that if you persued it and it got as far as court, TMO would win as you failed to get the documents back in the specified time..........Gettin' There, Wherever There is......

I do not think that you stand a chance of getting anymore cashbacks out of The Mobile Outlet now, at least you got some from them from your first two claims.
What may change things is if you chased them with regards to them paying you late. This will go to show them, and more importantly a court the importance (Or not) of deadlines.
It is worth a letter, but I would omit any mention of sick relatives and knowing that you have not followed the terms to get your cashback.
By posting so much detail on this site, you have already alerted them as to your possible identity, so they will defend their position strongly.
In your position, I would submit my 3rd claim as normal, when I received a rejection letter, I would then point out the delays on their part previously.
If this didn't work, I would pay £30 and take a chance with a hopefully sympathetic judge.
To put myself in a better position, I chased up my 1st claim with them once it was a day late, and continued correspondence showing my displeasure.
If I miss a deadline in the future, I will have plenty of correspondence pointing out the double standard to a judge, whom I am confident will support my view.
There are the others whom allow The Mobile Outlet lots of grace whom (I believe) have weakened their position by not doing this, but it's their money, their choice.
