OK......an update....
Some 3 days after advising them that I was starting Court Proceedings, I get an E-mail confirming that they had received my month 12 invoice (which was actually delivered well over a month ago!) and that they would deal with it within the next 7-10 days.
I replied, that this was unacceptable, that they were already beyond their own deadline for payment, that I had already started court proceedings and that they would have to now pay the £180 cashback + £30 court fees + £1 statutory interest.
Today, another 4 days later, they E-mail me to say that a BACS payment of £180 has been made and to allow another 3-5 days to clear my account.
I have again written them to inform them that they now owe me £211, which includes court fees and statutory interest. I have advised them that if they do not pay the TOTAL amount now due, that I will continue my court proceedings, and if necessary pursue any outstanding amount through the appropriate channels. I am prepared to follow-up with bailiffs if necessary, if only to recover the £31.
'I' am in the right. 'They' are in the wrong, and they would have saved themselves the expense, if they had acknowledged ANY of my previous E-mails rather than wait until I had started court proceedings. I will NOT be out of pocket by £30 just because they have decided to pay up now.
Let's see if/when they pay up....

Someone from the mobileoutlet used to visit the MSE forums and post on some threads. Some people have been able to send them private messages AND get responses – although I haven’t, recently. People have also reported some success ie. a reply, when e-mailing this particular address directly.
Be aware though, that you will almost definitely get an automated reply from these addresses stating that there is a delay due to some technical issue or another. I have sent 10’s of messages to themobile outlet over the past year or so and I have ALWAYS received an automated response saying that there will be a delay in replying. Sometimes I did received a (delayed) reply, but more often than not I never received any reply at all.
Funnily enough, since I started Court Proceedings against them, I have received three E-mails from them in the space of a few days……
‘Personally’ I will not accept ANY of their ‘technical issues’ as a reason for a delay in receiving a cashback. For a ‘different’ company, I would allow some leeway. However, THEY will use any reason to dismiss a claim (whether or not WE had some ‘tehnical’ issue at our end), so I see no reason to accept any of THEIR attempts to delay payment of cashback.There are 10 types of people in the world. I sent my cashback claim 4/5 to the MO and it was received on 20th June. Today I have received emails saying that the claim was successful and that I will be paid by BACS within 10-14 days. Here is a copy of the email:
Dear Customer,
We can confirm that the cash back application you recently submitted has been successful. Your details have been forwarded to our accounts department who will issue payment by BACS within the next 10-14 days. If your bank details have changed since your original order, please email [EMAIL="customerservice@themobileoutlet.co.uk"]customerservice@themobileoutlet.co.uk[/EMAIL] and we will arrange a call back to have your details amended.
Due to a server issue we have had there is a delay in processing claims received 1st June - 13th June 2007. This backlog will be dealt with over the next 10 working days. At present we are making all payments by BACS, but claims received between the above dates will be paid by cheque.
Please accept our sincerest apology about the delay incurred in processing your cash back application. Kind Regards,

This is the quickest that I have received an email acknowledging receipt of my claim (20 days). If the BACS payment is in my bank within the 14 days specified, then that will be a total of 34 days from submission of the paperwork to payment, which is not too bad in the scheme of things. I will update further when I receive payment (baby permitting!)
In the meantime, I am awaiting my bill from CPW to send off for my 5th and final cashback installment - then I'm out of here!!!!!!0 -
Just to add my tuppence worth, I've just come out of my 12 month contract, and my last payment of £165, paid by BACS last week has now shown up in my bank as cleared . This is a month or so late, but I feel very relieved to say the least!!

i posted a while back about 3 rolling my 11th and 12th bill into one final bill and TMO saying they were rejecting my claim because i hadn't complied with the t and c's.
after a bit of advice i e-mailed them stating this point and i have finally got the follwing reply
Hi,
We are awaiting verification of the change in issuing of bills by 3. Once we have confirmation we will contact you to discuss your claim.
Now i'm wondering why they need 'verification' and am thinking its just yet another delaying tactic by them especially as they say they will contact me (its hard enough to get them to reply when i contact them nevermind waiting for them to do something off their own backs)
so do you think i should reply to the e-mail giving them a set number of days (and if so how many) to reply otherwise i will start to pursue a claim?

I just wanted to let everyone know, I am a very happy man today.
I have taken MO to Small Claims Court and won today.
(I feel I won’t be able to that without help of this forum!!!)
To cut a long story short, they rejected my claim in August last year on the basis of “received outside of 21 days”.
However, I stand vindicated and the District Judge totally agreed with me on this one:
it doesn’t matter when they actually receive it as long as it is posted within 21 days.
So, if you feel in any way MO strayed from they own T&C - do take them to court and don’t let them get away with it.0
