I filed my Claim yesterday against themobileoutlet.
I sent them an E-mail, advising them that I had started court proceedings, and that they now owed me £180 (the cashback) + £30 (the court fee) + statutory interest up to the date they paid me.
E-mails went to all 4 of their e-mail addresses, and I received the standard automatic replies that there was a 'possible delay' etc...
Then today, they have sent me an E-mail saying that they have received my 12th statement and to allow 28 days for a response.
But....they received my 12th statement on 25th May, so 28 days from that date was 22nd June - when the cashback was due.
I've written back, saying that it was unacceptable and that Court Proceedings had already started.
Will just have to sit back now and see how long it takes them to pay up.
If they don't pay the FULL amount £180+£30+interest, then I will continue my Claim.

My thoughts,
If The Mobile Outlet allows you to take out another contract(If they won't, get a friend/relative to do it), I would stick with them if you believe that they are still going to be in business by the time a new contract expires.
Why I suggest this is because you now know the strokes they will pull in order to weasel out of paying up. I do not believe that going to a whole new way of claiming cashback from another company is that wise. Better the devil you know?
Remember cashback in full automatically ? Those were the days.
Couldn't it be argued that if you had to take them to court to extract your money (at their expense) then you are increasing the likelihood that they won't be around to pay your claim next year (especially if you are not alone in doing so)?
Reading this forum, there doesn't appear to be a cashback company you can be sure isn't struggling financially, I decided to try to reduce my risk by sticking with the CPW (at least they are big).
It would be alright if it was just me that remembered to claim my cashback, but everyone else is doing so too! :rotfl:Toyota - 'Always a better way', avoid buying Toyota.0 -

Of course every court claim increases the likelihood of their demise.
The Mobile Outlet have 28 days + reminder + 7 day letter before action at the minimum to avoid the court costs, so I have no sympathy for them.
Others (Like yourself?) give them even more time than this, so if they stop trading, it's not because customers are 'Trigger happy' filing court claims.Well life is harsh, hug me don't reject me.0 -

cb#2 of 5 update: now is day 57. I have not been at home to check my e-mails (see post of 1-7-07, on page 10 for reasons) but I gave TMO 5 days to pay cb#2. That is tomorrow (Fri 6th). I will be home tomorrow to check on this, and if not paid then I will be on MCOL over the weekend.
cb#3 of 5 update:
as mentioned in my last post, cb#3 claim was sent in this week and delivered on Wednesday, so today is day 2 for cb#3. This may be irrelevant if I take them to court as I will claim for cb#2-5 inclusive plus court costs.I have every piece of evidence I need including all the conflicting e-mails sent to me by TMO, so I forsee no problem in getting judgement, if indeed it gets that far.
keep the info flow going guys, you know it makes sense....

If they are still only opening mail from May (I wonder if this includes court summons?), you are in for a long wait. :cool:Well life is harsh, hug me don't reject me.0 -

Assuming payment does not arrive on Monday, send a polite email on Tuesday asking for confirmation of a payment date within 2-3 days. Respond to any delays as not acceptable and insist on indication of a payment date within 2-3 days. Keep on top of any promises made to you regarding payments..

However I am a bit concerned abot them going bust in the middle of my contract - what does everyoe think the likelyhood of that happening is??Wycombe Till I Die0

I don't think that it is fair to get people to air their guesses on a public forum, maybe people can PM you if they choose to?Well life is harsh, hug me don't reject me.0
