  • Hi All,
Thanks for wonderful information in this forum, I am facing the problem of cashback from Mobiloutlet from last 6 Months, I will try to describle in detail.

I ordered the my mobile phone on 8th April but received only 14th April 2006, I was not able to connect my mobile to network Orange, Orange told can be connected by mobileoutlet only. I call mobileoutlet & send E-mail after many attempt my phone connected by 8th May 2006. According to terms & condition I send my bills 1-6 from May till oct for my 1st cashback claim. I had another contract from orange from March & in May month I received both contract bill together where outstanding amount £25 from previous contract. But in this bills it clearly written connection date 8th May for this contract.

Mobileoutlet denied my 1st cashback saying I send bills 2-7 not 1-6 but later I send there E-mail corresponding showing my mobile connected by 8th May 2006 not before & how can I recive the bill before connection date, They again denied and saying my rest of cashback also invalid. I again send them my previous bills (Photo copy as these bills not belong to mobileoutlet). Now still they denied that I send bill 2-7. As they already breached my contract, Do I need to send bills for 2nd cashback? Actually they alreadt denied cashback for full year & they already breached the contract so I am entitled for full cashback. Can anybody give me full advice of similar case?

After this much hassle I put the claim through SCC full amount £360 + £50 court fee and now mobile outlet made as defence. I already have all the proof & i send mostly correspondence by recorded delivery. I am staying near basildon I think case will hear in basildon combined court ..........

Can anybody give there experience if anybody got defence from mobileoutlet what was there case outcome????? If someone can advice how to present the case in court as I am new in this matter.

Thanks in advance for any help.

    sjain_in,

    Keep it simple.

You need to show the court that you sent the 1st 6 bills after you were connected.

If you have written confirmation/ e-mail notification that they have deemed your entitlement to any further claim to be invalid, do not bother sending in your 2nd claim.

    You will win your case.

The Mobile Outlet will pay up.

Take out another contract with them and claim all your cashback again.
Well life is harsh, hug me don't reject me.

Some of you may remember, I also had a problem with my whole cashback claim, I pursued it via SCC and TMO settled the full amount including costs. The thing is, my contract expires in approx 2 weeks, and apropos of the comment above by The Saint, ie get another contract and start all over again. Is this wise? Should I put myself through the whole process again, or simply start with a clean slate with another company?
    Any thoughts/advice would be welcome.

  • Hi thesaint,
Thanks for quick reply, I want to know if i win the case Can I claim further for travelling & time off from work for attending court proceding. If yes then what I have do ???

BTW: I think I will win the case & all the paperwork in order otherwise I never go for SCC but if someone share there hearing in court that will be nice.

    Thanks in advace for feedback.

  • I think you should start with new clean company, it's not worth to spend time with Mobileoutlet (It's big hassle to solve cashback issue with phone & letter communication, then go through SCC). You can try with e2save or newcoolmobile they sending cashback timely manner without any reminder. I feel Mobileoutlet try to find the way to invalid your cashback somehow ......

Err.... maybe you don;t follow CoolNewmobile and Phonebox Direct threads; they USED to pay in a timely manner by all acoounts, but I think I'll be waiting a while for mine nowadays! Still, they DO seem better than most. Even E2Save are getting worse in certain departments. I have several contracts with these companies but more experience with cpw sites so it COULD get interesting!

Anybody know of any "new clean companies" who offer 12 months free line rental of around say £45 per month plus a sexy free mobile phone, and pay the cashbacks automatically on time without any hassle......

    My thoughts,

If The Mobile Outlet allows you to take out another contract(If they won't, get a friend/relative to do it), I would stick with them if you believe that they are still going to be in business by the time a new contract expires.

Why I suggest this is because you now know the strokes they will pull in order to weasel out of paying up. I do not believe that going to a whole new way of claiming cashback from another company is that wise. Better the devil you know?

Remember cashback in full automatically ? Those were the days.
