Thanks kltpzyxm for your reply. It gives me a bit confidence now. When I sent my first two claims and asked for confirmation, they replied in two or three days, this time it seems a bit strange. well, I should know how TMO deals with customer.

Fingers crossed don't cut it I'm afraid - you need to be proactive on this. If your claim was received on June 20th, then on July 19th, 29 days will have elapsed (the T&C state "please allow 28 days for delivery of cheques", and not 21 as your earlier post indicates). If you have not received PAYMENT (not a promise of payment) by that date, escalate straight away. See other posts from myself, GunJack & Brenda regarding our own personal experiences, and the action we have (are) taking....0 -
Firstly Hi this is my first post but I have been reading the forums on and off for some time now.
I am just waiting for my 6th bill so I can claim my cash back, I have checked mobile outlets terms and conditions and they have changed. My delivery note did not come with terms and conditions on the back. does anybody have the terms and conditions from around Dec 2006 to Jan 2007, the first cash back claim for cash backs over £201 was 6 months.

I believe that someone has posted the T&C's somewhere, have a good read through.
I got my contract in December 2006, and the first cashback was after the 4th month, not the 6th.Well life is harsh, hug me don't reject me.0 -
kltpzyxm, that is also I am worrying about. For last two claims, ususally after a couple of days I sent quires about claim documents, they would reply to promise payment. However this time there is no any feedback even after one week.
When I said "21 days", I meant the period to send bills to them for cash back claim. Although I don't mind to be paid a few days late, I will definitely fight for every penny they owe me

if your cashback was less than £200 then it is paid in 2 stages - month 6 and month 12. If you have an 18 month contract, it is also paid in 2 stages - month 12 and month 18. If your cashback is greater than £201 (for a 12 month contract) then it is paid in 5 stages, starting at month 4 as thesaint has indicated above. These conditions have been in force since I took out my contract in October 2006. Not sure which T&C you are referring to....0 -
Ok, my update,
1st Claim received on13th May!!! got email after 31 days saying it had been accepted and bacs payment would be between 7 & 10 days! After 10 working days I emailed saying they were late.
I was just about to email again telling them they would have a limited time to reply to my email and have the money in my account before I would take matters into my own hands, when I thought I would check emails before I jumped in and they have sent me an email saying money has been sent to my account and to allow 3-5 days for it to clear!
That was on day 50! (2nd July)
I will keep you all posted when it goes into my account.0 -

OK, I've reached the stage where I need to go to Small Claims Court.
I received my first CashBack cheque (albeit late and after some chasing.)
But now I'm having trouble with my second and final cashback.
I have complied with all their T&Cs - sending back 11th and 12th bills appropriately, yet have not heard anything back from them.
My 12th bill was dated 12th May 2007.
I sent it by recorded delivery on 24th May 2007, for delivery next day 25th May 2007 (for which I have proof of signature).
I E-mailed them on 25th June 2007, asking why I had neither received my cashback cheque nor even heard from them. I also gave them one week, specifying a deadline of 2nd July 2007 to reply, otherwise I would undertake court proceedings.
Again I received no reply.
I have again E-mailed them today 3rd July stating that I have given them sufficient time and will now commence court proceedings.
I received an immediate automated reply this time, stating:
<<Due to a server issue there is a delay in processing claims received 1st June - 13th June 2007. This backlog will be dealt with over the next 10 working days.>>
However, since my claim was submitted on 25th May 2007, I would have assumed that it was prior to this backlog.
If anyone has any further suggestions they would be gratefully received.
Otherwise I will commence Small Claims Court proceedings tomorrow.
One question - I understand that I can include the costs of the proceedings in my claim against themobileoutlet. However, what if they pay up the outstanding amount - £180 - prior to completion of the case? Do I then have to continue my case in order to recover the court costs?

Just for clarification, I always send my claims by SPECIAL delivery, not RECORDED delivery as I stated in my previous note.
