Thanks for thar guys exactly what i wanted. I am making my final appeal to TMO for my final cash back payment which they say I have infringed but I was on two redemption option rather than 5 thay say I didnt send right bills at right time yet they paid out at 6 months. '3' also changed the way they distribute final bill if you cancel immediately. They now delay the 12th account by a month rather than send two out. so you pay month 12 line rental and any owed extras in one bill rather than over two. TMO acknowledged they were aware of this. My next port of call is Moneyclaim unless theirs an Ombudsman I can appeal to?
i think i have been stitched up by this development-i claimed my 1st cashback ok but TMO are declining my second claim because 3 rolled my 11th and 12th month bills into one final one-thus they say i haven't complied to there terms by sending in the 2 bills within 21 days of date of issue- but i can't see how i could of.
surely sending in my 12th bill that includes the charges for my 11th is technically the same (but somehow i think they will see it differently if it saves them £140 or so)
do you think there is any chance of pursuing this further?-ie if i keep trying with them and get nowhere will i have a valid claim in the small claims court or should i just put it down to experience and bad mouth them to everyone i know and never go near them again even with a barge pole0 -

Kinda depends on the amount of money involved. Personally I'm of the opinion if it's a relatively small amount say £50 (yes I know thats still a lot of money) then chalk it up to experience and decide that it's not worth your time and headaches for £50.
I don't really want to go down the road of pursuing them but it's £360 in my case0 -

cheers for that-in my case its a little under £160 which although it isn't make or break whether i get it back if i have a legitimate case to chase it i will.0 -
I would have thought you could reasonably demonstrate that their terms & conditions were impossible to fulfill due to '3' amalgamating your bills.
Perhaps just send them a letter/fax pointing that out and see what action they take.0 -
Personally.... I would definitley take them to court. I would also copy all the threads from here about them which demonstrate what they are like. I strongly suspect that if they really believe you are going all the way they will pay up. The t&c make it impossible to comply so are unreasonable and I think a court would agree; besides, they must know how Three do their billing when they write their t&c. Unless I got knowledgable advice to the contrary I would pursue to the hilt - plus cost AND interest. This is one of the three WORST companies to deal with by all accounts - and they strive to get away with as much as they possibly can! Small claims court (or today's equivalent) is pretty straightforward and cheap - even easier since the claim can be made on-line.0

I originally posted on this thread stating I had had no problems with them, but now.
I have three outstanding claims going back to the 4th May when they stated going for cash back would receive in 28 days alas nothing.
Sent them an email today, stating I wanted action from them in 7 days or i would take it further!
I would be grateful if someone could inform me how to use the small claims court online never done and it is for £270 and of course the rest on the phone!Be ALERT - The world needs more LERTS0 -
Could start by having a look round here (one quick search on google but there will be other infor). remmber to add costs and interest (you don't have to specify the latter as the court would work it out). IF you end up proceding, make sure they pay you the court fee as well as what they owe you or carry on! Though personally I think they'd cough up if you've followed their t&c.0
