    Thanks again Quentin. I'll do that - I think you have talked me into doing this tonight before I lose all chance of getting back what is owed. It's awful that this company is allowed to continue like this for so long. I'd have thought something could have been done about them :mad:

  • I too am owed 2 cashbacks from this company and about to send my third. I too also advise not to purchase any pohones off them until they get their act together.

    Emailing them or phoning them is futile - they don't reply

    I've posted the form indicating that I wish to proceed with the claim to all 3 addresses. Anybody have an idea of how long it would take before we can take TMO to court. What will be the next step? I'm a bit worry that TMO would go bust before I can take them to court.
    No reliance should be placed on the above.

    In my humble opinion, I don't think there is any chance of TMO going bust in the near future....why would they?.....they are not paying anything out unless you visit them personally...or the bailiffs manage to extract some lolly from them....Think about it, lots of people are going to be discouraged at the thought of actually going to court in person...It started with emails being ignored, then LBAs, then CCJs, then bailiffs....as I posted earlier, you need to be preapred to go the whole 9 yards on this....I reckon that for every successful claimant, there are at least 20 others who give up....anyone else got any views on this???
  • I just received the details of the defence by TMO. It seems in my case they 'have received no claims for this order so far and no proof has been provided to show any claims have been sent in, so no outstanding cash back to be paid'
    so my recorded delivery receipt as proof of delivery means they 'lost' it just after they received it. As to why they failed to respond to my emails asking for confirmation of receipt (stating I had proof of delivery from RM), and then failed to respond to the LBA - which included my previous attempts at correspondence - who knows?
    I guess they think that if they bury their heads in the sand and do nothing people will give up and go away. As this forum shows - WRONG!!!
    I believe when the Judge sees the information laid and the paper trail I will be awarded judgment - I just hope it is not too late!

    While I hope you are right in them not going bust - they will have wages and rent in addition to the bailiffs to pay and I cannot see them getting any income from the website as they are offering no decent deals at all.

  • Just found this forum and reading it i can see matters are much worse than i thought. I am on my second cashback claim and was just about to claim with MCOL when i found this thread. Would it be worth now filing for the whole 5 claims at once now? Will TMO at the moment make it go to court regardless of how clearly they will loose?

    This may sound stupid but does anyone think that if TMO go bust then there may be a chance with contacting your phone provider (orange) as they must no this is happening and have not done anything to stop this most likely paying commision to TMO.
