My 2nd claim is late - special delivery over XMAS taking 12+ Days. I DEFINATELY asked for concequencial loss - not ticked on back of reciept (blank). Looks like not charged for but I ASKED FOR IT. Can I make a claim? How can I get evidence of the loss if TMO don't tell me (no contact for a month after sending it, so they are not claiming it is late yet).
First claim not paid. Going to take them to court. Maybe I can take them for the whole amount? If they go bust in the meantime back to trying to get money from Royal Mail? Do I have any hope?
The post offices in the country are as appauling as my spelling (once a recorded delivery item was sent back to me because the post office put the stamp on the wrong side, and it took an argument to get that resent).0 -

Your best course of action is probably to pursue the non-payment of your first claim. Read the whole thread for invaluable advice....0 -

Hey Julia :j youre in the same boat as me!! my contract was taken out early june and ive had exactly the same experience as you.
Because the contract is in early days and youre cashback due is only two fifths of total so far it is not worth going to TMO offices and demanding money - unless you live nearby and can go every two months for each stage.
Best bet is to get the MCOL claim going so you can claim whole amount in one go, now that TMO has failed to keep to its obligations. TMO will defend the claim saying they sent you a cheque in the post and quote some cheque number, but file your return to continue anyway. This will drag on for couple of months and then there will be further delays and maybe you get baliffs involved more delays might get paid out in june? but at least youll have a chance of getting money. if you dont do anything its likely you wont get anything anyway. they will probably go bust at some point, but until such time as they cant continue due to adverse publicity or protestors barricading their premises or whatever they will keep going with this scam and drawing money for the directors of the company - who are ultimately responsible for doing this to you.
So, if you can afford the extra 90 odd quid to stand a chance of getting your full contract money back then go for it - you might lose it all but its a risk. The sooner you start proceedings th more likely youll get some money back before they pull the plug. Otherwise be prepared to blow your cashback for sure by doing nothing.0 -
Under the present TMO response, you need to budget £140 for a MCOL:
Issue fee (amount being claimed £300-£500): £35
Hearing Fee: £50
Application for a warrant of execution: £550 -
Yup, went to bailiffs and paid the £35, it took about a week after I used MCOL to issue the warrant, out of interest contacted the bailiff dept at Bradford CC about a week after and she'd just got back and they had assured her that my cheque was in the post, which it had been. I'm currently waiting till the 9/2 to start judgement on my 2nd MCOL, still no update from the 2nd MCOL claim for my 3rd 4th and 5th cashbacks, 3rd has been accepted by TMO, 4th and 5th i have printed copy of them being signed for at TMO from Royal Mail website, and also they still have not sent me my 2nd email for the 4th cashback to say it has been accepted,I did get email to acknowledge receipt tho. I also emailed the Bailiffs office but wasn't sure if they would be able to answer my query. Anyway they did. I explained that my judgement was in the name of The Mobile Outlet and basically asked if this was ok or did it have to be in the name of Mobile Matters (UK) Ltd t/a The Mobile Outlet and I got the following reply from them:
You can apply in the name of The mobile outlet as long as is it is not Mobile outlet Ltd, as this is a different company.

I arrived in this evening to be greeted by a lovely cheque from the mobile outlet for £144 , which i will copy tomorrow and put in the bank, i will let you know whether it clears. Just to let everyone know on my MCOL I input the defendant as The Mobile Outlet, and also with their Shipley address, as everything that had been sent so far and in my terms and conditions was that address. Further to my email received yesterday it was only the acknowledgement that they'd received my documents of 4th claim, yet to receive my second email that used to follow close behind accepting, watch this space !! :beer:0
