    Hi pjnsmb,
Your answer to (1) is not correct.
I Submitted a claim through MCOL, and I am now in the same position as adgupta.
    TMO are defending the claim.
Once you have received the defence from the court, the only way to proceed is to fill in the form that the court sends out indicating that you wish to proceed with the claim and send it back to them and also send a copy to the defendant. I'm not including a covering letter to TMO when I send my form to them.

    Hi kltpzyxm and pjnsmb!

I have just received the defence from TMO. They are a liar. They claimed that they have sent me a cheque which I never receive!

Anyway, which address do you use to send the form indicating that you wish to proceed with the claim to TMO? I filed MCOL using BANTAMS BUSINESS PARK but in the defence TMO use RIVERDALE HOUSE address as an address to which notices about this case can be sent to.

I understand that if I use RIVERDALE HOUSE address, the form is going to be forwarded to BANTAMS BUSINESS PARK address any way. But do we need to follow the address that TMO put in the defence form?

    Many thanks
No reliance should be placed on the above.
  • I wanted to offer some encouragement to anyone who lives nearby and is able to visit their offices.

We've got 3 contracts in the family that ended in December last year and the first 2, 2 and 3 cashbacks had been paid but the rest were still outstanding.
After reading the helpful advice on this forum I went this morning expecting the ususal excuses and runaround from them.
I was suprised though, I went with copies and records of all documentation and all they asked for was my order number and within 5 minutes or so they returned with a cheque for the full oustanding amount (blimey, they'd even signed it).
After success with the first, we showed them the details for the other two. The only downside was that as my Dad had already initiated the MCOL, which they were already aware about, for his contract they were unwilling to give a cheque for this one even if we offered to end the claim (I suppose they judge us by their own standards) but we did get a cheque for the final contract.

Now I just need to wait for them to clear . . .

The Riverdale House address is no longer occupied according to earlier posts...and as you have stated, it has a postal redirect in place...
I take the belt and braces approach, so I have sent my Claimant's Reply to all of the addresses used by Mobile Matters (UK) Ltd that I am aware of, including the email addresses I have....and back to the court of course.....

I'm confused. I want to issue a warrant. Lambeth (where case was heard) are telling me to fill out some N234? form and send it to Bradford. Bradford are telling me to send it to Lambeth and they will then forward it on once the warrant has been approved.

Anyone help me out with what the correct procedures are?

Normally you apply to the court where the judgement was issued for a warrant. Apply on an N323.

Once issued they then send it to the appropriate court bailiff.
  • ***Warning*** - Mobile Outlet Rip Off
    Hi all,
I'm new to this forum and you may have heard this one before.
I have a cashback contract with The Mobile Outlet.
Basically it involves a contract with Orange and the Mobile Outlet are supposed to pay cashback.
Quite simply they don't pay up and complaints are just fobbed off.
By the end of my 12 month contract they will owe me a total of £384.
    Be aware.
Don't sign up with them and ignore thair rubbish claims of quality assurance.
Orange won't let me cancel either unless I buy out.
    They aren't interested.

    Don't deal with them.

    Regards:j

Did you get defence by post or can you see it online? TMO has filed defence against my claim but I have no idea what they have said.

You will get it through the post, together with instructions on how to proceed.

Now the defence has been lodged, the case will be taken out of the MCOL system and transferred to your local court.
