What is it about the advice you have read (and quoted in one of your earlier posts about this) that you want clarifying?

I have issued a claim against the Mobile Outlet as that is the name they are known by to me. Yet I have read earlier posts saying that claims should be filed against Mobile Matters. What is likely to happen to my claim now when they ignore it?

Just to let you all know visited their office at the football ground on 24th January and got the same treatment as everyone else, ie shown cheque (unsigned) and told it would be signed and posted following day. Declined their kind offer!! and said would return later that day for signed cheque and that if it was not ready would wait until it was. Needless to say they were not happy with this but as I pointed out if they were going to post a signed cheque tomorrow then someone must be coming in to sign it today.
Went back about 3pm and amazingly the signed cheque for the full amount was handed over. Took the advice of previous poster and have waited the full 8 days to make sure that cheque has cleared and fortunately no problems.
    RESULT!!

    It will just die.
  • same story as emil_ge and megane,
i went on friday to their offices and i think i bumped into emil_ge ,
Ali gave me the same story i went back around 1.30pm and there was still nobody to sign the cheque ! he offered to post them out , but i said i would return today monday ,
fortunatley i had buisness in bradford both days so a visit wasnt too much of an issue, however strangely after i left Bradford on friday Ali called me at 3pm to say the cheques had been signed and if i was still in Bradford would i like to pick them up !!!!!!
anyway i returned today to pick up my 3 cheques , they went straight into the bank. will let you know if they clear.

Thanks for the reply. Is there nothing I can do about this? Perhaps contact the court? Nowhere in any correspondence with me is the mobile outlet referred to as anything other than that. Even on their website there is no mention of them being a limited company. Surely a claim can be issued against a common name that a company trades as?

No there is nothing you can do apart from issue a new claim.

There is advice on who to issue claims against in the MCOL claimants user guide:

Thanks again. Its worth my while paying another £25 to do it properly. Can anyone who has been successful confirm the name and addres they used to claim against?
