You have got to enter into the form YOUR individual circumstances, each case is really different.

Particulars of claim
MCOL is designed for, on the face of it, straightforward money claims and the particulars of the claim for these types of claim are generally fairly concise. Please note that there is a limited amount of space for details.You must be able to set out your particulars of claim in no more than 24 lines totalling no more than 1080 characters (including space and punctuation). Please note that the only punctuation you can use is full stops or commas - all other punctuation is treated by our system as illegal characters, including £ signs. You may wish to write out your claim, in draft, before completing it on MCOL, to make sure you do not exceed the 1080 character limit. You may be able to edit out unnecessary words or phrases. The MCOL particulars of claim screen has a character counter to help you. You cannot however copy and paste into the site from another program.
If you cannot restrict your particulars of claim to 1080 characters, you cannot use MCOL.0 -
I have a MCOL case against TMO, I recieved a letter from Bradford Court stating that TMO have asked for the Judgement to be set aside as they didnt recieve any documentation from the courts. Anyway the main issue is the hearing will be based in Bradford I am from the midlands, i understand that as I am an individual the case should be heard in a court nearer to me. Having contacted MCOL they told me to contact Bradford Court, who i contacted and they werent really helpful saying that my case would have to be considered and i would need to write in and the judge would neeed to decide if the case can be transfered to my local court. Is that the same for everyone, do you have to write in to have your court transfered to your local one?

there is so much talk about mcol - has anyone ever tried a regular solicitor? i know they are expensive, but what about a no win, no fee type? do they take on such cases?0

Sorry to give you some bad news but, whilst solicitor can act for you there is limit on how much of the fees you can claim from the defendant for a contract dispute for less than £5000, I think it's about £30. Solicitor's costs would probably be two to three hundred pounds all in. So, as full fees cannot be claimed form the defendant, and as the defendant is not an isurance company worth many millions, getting a no-win-no-fee agreement is very unlikely.
The process of a small claim is quite stright forward, the online guidance is good and court staff are generall helpful.0 -

Thankyou for that.It was just a thought so I will rule it out now. I am just so scared of the mcol thing as it seems to get mixed results. i have got 2 claims to process as well so I have got double the costs.it's the bailiff bit that worries me most. after all that, do people really get what they are entitled to? i had resigned myself a few months ago to the fact that i would never see my money but after finding this site i am feeling, why the hell should they keep £750 of my money? i have sent them an lba anyway so i think this week i will have to take the plunge and fill out a mcol. my 4th bill for one of my contracts was delivered late(royal mail are so bad!) but according to most info, this would not matter as they broke my contract at not sending me what i was owed from bills 2 and 3 even after i had received the promise in payment. have i got this right? any advice would be most grateful!!0 -

Sorry to hear that it is £750 they owe you. I think you can sue for both your contracts in the same application which is cheaper than paying 2 lots of fees for 2 separate actions. You would also only need to keep track of one set of court documents.
Also, try breaking up your text into paragraphs of about 5 lines. It can be difficult wading through solid text, so rather than read to the end, people can give up and so do not write a reply.

Can you do 2 contracts on one application,thought i read somewhere on this thread that they had to be done separately.

So, say you win £750. A percentage, 10%, 20%, I don't know, is deducted before you see your winnings. So despite winning you have actually lost £75 or £150 or maybe more.
I cannot imagine a 'no win, no fee' deal being offered for this relatively small amount.
Have more confidence in the MCOL route is my advice (for what its worth).0 -

Yup, went to bailiffs and paid the £35, it took about a week after I used MCOL to issue the warrant, out of interest contacted the bailiff dept at Bradford CC about a week after and she'd just got back and they had assured her that my cheque was in the post, which it had been. I'm currently waiting till the 9/2 to start judgement on my 2nd MCOL, still no update from the 2nd MCOL claim for my 3rd 4th and 5th cashbacks, 3rd has been accepted by TMO, 4th and 5th i have printed copy of them being signed for at TMO from Royal Mail website, and also they still have not sent me my 2nd email for the 4th cashback to say it has been accepted,I did get email to acknowledge receipt tho. Updates as and when
