Hi, I will also visit their Bradford office in the early morning on Friday 1/3/08 and wiil try to be there around 9:30 am. Will anyone else go on that day? Danjen123, will you able to make it on the next day instead? Anyway, good luck to Rajbinder and else. Could you guys also update the result after your visit? Many thanks.

Hi there, I have been to TMO office today. Not hard to find at all, just follow the football ground sign to the end once you get to Bradford and the office in just located next to the stadium. Surrounding it is a business park. You cannot miss it and there is a car park or you can park on the streets free.
The lady at the reception just told me to wait upstairs where there are seats available. Then this asian guy just came out from the inner offices and asked what the problem was. Obviously he must knew what I was there for. I told him that his company still owe me 4 payments. He asked for my order number and I just gave him the paperwork I brought with me and he took it into the office. About 5 mins later, this asian girl came out with a cheque for £84 surprisingly as I thought they would make up excuses not paying out. However, I told her that it should be 4 claims in total so she asked me for all the bills. (By the way a word of advice, if you are going up to the office, make sure you provide copies of all the postage receipts). I gave her all the postage evidence and about 10 mins later she came out with another cheque for £126. She said that my 3rd claim was 9 days late and strictly speaking I should not be entitled to anymore cashbacks but she said she was willing to pay me fully for the 5th claim and half of the 4th claim. As for the 3rd claim, she advised me to claim compensation from Royal Mail where she can provide me with a letter if necessary to show that the claim was received 9 days late despite sending by 1st class recorded delivery.
Of course I took the cheques. Better than nothing. At least I am just short of £126 and if I can't get anything back from Royal Mail, at least I have got 70% back from TMO which is better than waiting and going thru all this hassle with the courts and bailiffs and risk not getting anything at all if they go out of business. To comfort myself, that irrecoverable amount will be for payment of the free phone and the 1 years network service which comes up to only £10 a month which aint too bad. I deposited the cheques straight away which should take about 3 working days to clear. Will keep you guys posted. So I suggest that people should visit them first before proceeding with MCOL to save time, cost and trouble. I think TMO will just pay whoever lands on their doorstep to avoid any hassle so if you live locally it is worth paying them a visit. It only cost me a fiver on petrol for the whole journey. Hope this info will be helpful to you all. Good luck.

Phoned HMCS today to see what pathetic excuse TMO have given as a reason to defend my claim. TMO say they have paid my cashbacks.

Have transferred case to Plymouth County court.
    :naughty:
Sounds like you are in the same boat as me mate...although I haven't responded to the TMO defence yet...

Are TMO paying anything out through the normal process or is the only way to get money to visit personally. They now owe me two payments and I have just posted a third, is the HMCS option successful?
    It pays to challenge

I dont think we will ever know this. people who are getting paid without problems, if there are any, are probably not looking to share their experiences here.

No. you can try the MCOL route too.

Just read a couple of pages of the most recent posts to find your answer.

Just phoned MCOL & TMO's defence is that my cashback was paid on 23rd December. If it was any other company I might have thought that it was a Royal Mail problem but thanks to this thread, I now know how they operate. Anyway, case will be transferred to my local county court which is a 10 minute bus ride away.

Congratulations! It's great to hear a (virtual) success story!! I live in South Wales so visiting Bradford is a big deal for me as it's 4 hours drive but as they owe me nearly £750 for 2 contracts I might have to seriously consider it. I sent them a stinking LBA last night by e-mail. Sent to all their usual e-mail addresses plus sent to the 2 directors and 2 od the sales assistants that I have managed to get addresses for. Obviously I have had no reply but I am hoping for the best. I am very wary of the MCOL route as I have 2 claims to make and not sure if I can cope with the stress. Perhaps a journey to the office would be the only way to go and put my mind at rest. What does everyone think?

Abbica, you really should consider also sending your LBA by Recorded Delivery regular mail too. It is too easy for the recipient to claim thay didn't receive the emails.

Thankyou for that. will do it tomorrow. any other advice on whether i should see it thorough to the end with 2 claims to process? really can't afford to lose a lot more money. feel so mad with myself for being fleeced this way. had a cashback deal with the carphone warehouse for 2 years with no problems.
