Update - TMO have today contested my whole claim against them for £252 even though I have a mountain of evidence.
Awaiting confirmation from HMCS and will definitely go the distance purely as a point of principle.
Point to make, have seen lots of posts confirming that TMO are contesting claims. Appears they are desperately trying to discourage people so if you are in the process of persuing them, keep going. I haven't yet seen anyone state that TMO have appeared in court to make a defence.0 -
Can I just remind people yet again that recorded delivery is not reliable. You must use Special Delivery if you want a guarantee of delivery. I consider myself very lucky that I got a cheque for the full amount owed even though my last claim was lost, despite using recorded delivery. I guess you get what you pay for-70p for r.d. 4.30 for s.d.0

Special delivery alone is a waste of money.
If the item gets lost in the post, then you have lost not only the claim but any future claims as well.
Use special delivery plus consequential loss insurance (£5.65 altogether). (Then hope it gets lost)0 -

I have been waiting since October! It was my last cashback cheque so I could afford to be patient I guess and it would have cost more to go through the court/baliff process. Just keep pestering them with e-mails.. they reply eventually.0 -

I am about to begin legal proceedings against TMO regarding unpaid claims, and want to ask if there are any previous claimants from Scotland on this thread, as I am unsure whether I should be using MCOL (since TMO are based in England) or a Scottish Courts Small Claims Summons (since I live in Scotland). Any Scots gone after these guys yet?
Another question was regarding multiple claimants - can my wife and I make a single claim, or must we execute our claims separately?

i posted a few weeks ago to say that I was new to this from a Scotish perspective too. Unfortunatley we can't use MCOL, unless you have perhaps a friends address south of the border that you can use but my understanding is that you would need to travel there if it went to court. I am unable to follow the MCOL route so would need to go through the Scottish Courts system which seems far more complicated. There is loads of good advice on this site for MCOL but I don't thing many people have gone through from Scotland, so feel a bit nervous about doing it, since I have never done anything like this before. I sent mobile outlet my LBA last week and I am reading this site every day to decide whether or not to pursue - the Braveheart in me really wants to go for it!! Between my husband and I we have 4 contracts, two current and two finished. He is due £150 on his old one and me £75, not sure whether we will get anything from TMO for the new contracts at all), but on the other hand the Scottish path does seem so much more daunting. Anyway feel free to post if you find that its not as off putting as it seems at first glance, it might give me a bit of encouragement to proceed with you!

Judgement day through MCOL was yesterday and I was looking forward to the courts issuing a warrant of execution. I don't know what possessed me but I mailed TMO earlier in the week re 2nd cashback which they signed for on 21st December AND GOT A HUMANOID REPLY saying it was being processed - up to 11th December I was at least getting some e-mails from them then after that just the autoresponse. Now the status on MCOL has changed to defence entered. I still believe I have a solid case not least of all TMO's acceptance of my 2 claims so I'll just have to wait and see what excuse they give for defending (probably the usual cheque issued & must be lost in post).0

This company is a complete waste of time.
I encourage people not to take out contracts with this company.
I am at the moment waiting for my second cashback and i have phoned them repeatedly and they have given different excuses all the time.
I will keep posting if there is any change or if a miracle happens and they eventually pay me.0 -
