Filed MCOL 8/1/2008 for last CB payment
Asked for default judgement this morning (as soon as I could).
Judgement rejected due to TMO filing defence disputing the whole amount.
Another delay tactic, they have said my claim was successful...and I have another email from TMO saying I will be paid soon...The case is to be transferred to a court.
NB You MUST Be prepared to go the whole 9 yards with this if you are to succeed....
No doubt the defence is going to be the "cheque was lost in the post, but here is a photocopy" story...
As I have posted earlier, why would anyone take a photocopy of a cheque?
Unless they thought "it was going to be lost" ....YEAH RIGHT!!!
A crossed cheque is no good to anyone except the intended payee, or thats my understanding....correct me if I'm wrong please...

What's the redirection about? And is there a new address?
Patwa, there are lots of posts on this thread which mention redirection of mail. Just read the last two pages of posts and you will understand that they have moved and where they have moved to.
Advice is also offered in this thread as to whether you should send your claim to their new address or to the one that your contract tells you to use.
You need to do a bit of background reading.0 -

I arrived in this evening to be greeted by a lovely cheque from the mobile outlet for £144 , which i will copy tomorrow and put in the bank, i will let you know whether it clears. Just to let everyone know on my MCOL I input the defendant as The Mobile Outlet, and also with their Shipley address, as everything that had been sent so far and in my terms and conditions was that address. Further to my email received yesterday it was only the acknowledgement that they'd received my documents of 4th claim, yet to receive my second email that used to follow close behind accepting, watch this space !! :beer:0

When I sent my LBA I also sent emails several times to all the addresses at TMO that I could find on this thread. It said:
"Please be advised that you received my Letter Before Action on 7th December 2007. You have until 17th December 2007 to process and pay my claim. To avoid any confusion e.g. letters being lost or delayed in the post I advise you to inform me immediately by email or telephone when you have paid the claim. If you send a cheque in the post I advise you to use a signed for service, preferably special delivery to avoid a delay resulting in court action being taken against you. Once court proceedings are started I will pursue the full cost of the contract, interest and costs"
This was to help protect me against the lost letter defense. My claim is now with the bailiffs.0 -
I sent of my cashback in december and met the the terms and condition. the only thing i forgot to do was keep a photocopy of the dispatch note, would this make difference as i now have lost the terms and conditions and proof of receipt?
Anyway its been over 45 days and they still havent sent me a confirmation email, but when i phone them they say my cashback was successful and will send an email to verify this shortly. i asked them how long shortly was ? they said that due to their system failure it could take up to 1 month for the email.
Please can someone tell me what would be the best thing to do in my situation. ive read most of the posts before and i cant remember coming across this situation.
can some1 please give me advice as im a student and already short of cash. thnx0 -
Do not believe a word they said, just another tactic to delay. I have received many reassuring emails for payment. Here was one from Jas from early Dec, no cheque ever arrives.
