    If you want to try to get what you are entitled to, you must comply with the T&Cs and send your claims in....

    Bailiffs don't give up...they keep on going like a terminator...pity they aren't allowed to use the same bargaining logic & enforcement protocols....LOL

    Hi Rajbinder, I will be visiting their office on Thursday too to get my money. But I may get there earlier than you as I am only travelling from Manchester. How many buddies are going with you? I was thinking if you could get there any earlier, we can meet up and challenge these scammers together. The more people we have, the stronger our chances in scaring them and getting our hard earned cash back. But from the forums here, I see a few people have managed to collect the cheques in the afternoon after visiting them in the morning. so if we go in the afternoon, they may ask us to go back the next day so I am going to get there as early as I can. Can anybody tell me what time they are open? Thanks.

    You received an e-mail from TMO - HOW!!!!

    Who did you send it to and when.

    Of course it doesn't mean you wil lget the promised cheque, but lets hope.

    I e-mailed forumqueries@themobileoutlet.co.uk minutes after I posted on MSE the first time. She replied pretty quickly. This is the only address I have ever seemed to receive replies for (it was originally set up for MSE posters because there were so many complaints). Saying that, I e-mailed this address weeks ago and did not get a reply and in the past I have waited months and got nothing so have had to send yet another e-mail to them - so its hit and miss.

    Do not believe a word they said, just another tactic to delay. I have received many reassuring emails for payment. Here was one from Jas from early Dec, no cheque ever arrives.

    Does anyone know how many CCJs have been issued against TMO?

    If not, I will ante the ukp8 to obtain the details.

    With this information it is not a big step to argue that the Networks are negligent.

    Aware of the CCJs ( no company will supply goods if they do not expect to be paid), the networks may be considered to be conspiring to defraud.

    It is an interesting business model that allows a supplier to sell goods to a third party to be sold on and with the money coming to the supplier. Then, if the goods fail there is no comeback on the third party who has not received any money.

    Alternatively, it could be argued that the T&Cs come under the Unfair Conditions legislation and the whole of the contract, including the contract with the Network, can be repudiated.

    Any comments – or information on CCJs would be fascinating

  • Surely the timescale is a factor here - the networks might well know now that TMO are crooks, but when they issued the contracts in Jun, July, Aug, Sep last year, TMO was occasionally paying out cashback.

    As we have to wait 120 days before claiming, and then 30 days for them to receive it, then 45 days for them to pay, you are talking best part of 6.5 months before the networks have an inkling that something is amiss; so comeback will be unlikely.

  • Most of the networks signed up to the Ofcom code of practicelast July so they were perfectly aware of the general problems then, if not the specifics.
    I took out an Orange contract with TMO in November.This is what Orange said following the collapse of CNM as quoted on this site:

    "Orange recently reissued strict terms and conditions on cashbacks and we are working with our dealers to ensure high standards of customer service are met. Any retailer not conforming to our standards will be removed from our roster of distribution partners and will be stopped from selling Orange phones. We have already stopped working with over 100 dealers in the past 12 months who have not met our expected service standards."

    Yeah, right!

    And I'm awaiting a callback from Vodafone about my contract through Phones2udirect.

    Ah well, keeps me busy!

    Sorry if posted before, but is anyone else getting this on the Royal Mail tracking page:

    "Your item with reference xxxxxxxxxxxGB was delivered before 12:33 on 26/11/07.

    As the item was redirected, it will have taken longer than usual. Please ensure the correct address is used for future mailings."

    What's the redirection about? And is there a new address? I used the one starting, Suite 3-4, Riverdale House, Dockfield Road, etc.

    Dear Mobile Outlet,

    I have been e-mailing and phoning you for more than 16 weeks with regards to my cashback offer.

    My cashback reference numbers are XXXXXXXXX and XXXXXXXXXX.

    All my documents have been accepted and The Mobile Outlet has sent me six separate emails to confirm that my cash back requests have been accepted.

    The emails were sent on September 28 (twice), August 15 and August 13, July 19 twice.

    I have received only six payments of £108 out of a total of 10 that are owed to me.

    The outstanding balance is therefore £432. I haven't receive any payment since July 2007.

    You haven't bothered to respond to any of my queries since the beginning of 2008, this will leave me with no other alternative to get back what is legally due to me than to take you to court.

    I give you 10 working days to process my claim; on the 11th day, I will issue proceedings in the County Court for the recovery of my claim without further notice.

    Once I file the court claim, you will be required to pay me my cashback, court fee's and interest.
