    1. Not sure what you mean by sending the form back
    if you are using MCOL it is all done through the online system.
    MCOL send the necessary paperwork to The Mobile Outlet.

    If the defendant files a defence and the defendant is an individual, the case will be transferred to the defendant´s home court. Where the defendant is not an individual (ie: the defendant is a business), the case will be transferred to your or your representative´s home court. This means that your claim will no longer be handled by the MCOL system.

    This transfer is done automatically by the Court.

    I can remember a couple of cases where they have defended the case but then not turned up..............

    Your answer to (1) is not correct.
    I Submitted a claim through MCOL, and I am now in the same position as adgupta.
    TMO are defending the claim.
    Once you have received the defence from the court, the only way to proceed is to fill in the form that the court sends out indicating that you wish to proceed with the claim and send it back to them and also send a copy to the defendant. I'm not including a covering letter to TMO when I send my form to them.

Next problem is that my husband has a contract too so can i apply to mcol for both contracts together?they both come from the same bank account and when I have corresponded with tmo about the both contracts, they have answered about the both of them.(although, this was a rare occurence as you can imagine!)

    Hi, here is the update result for my last visit. Hope it will be useful for you. :T

    1. My 2 contracts with TMO just ended in Jan 2008, and I only have received 2 cashback from the 1st installment. In total, they owned me £768.00. (That's a lot mony and I was not very confident to receive all of them on that day)

    2. Arrived at their office actually around 10:30 am due to the bad traffic. An Asian guy (Ali) came out and took all my documents (recorded delivery receipts for all claims I made and email copies for some of the accepted/received claims with Ref numbers on them). 6 minutes later, he returned my paperwork and showed me two cheques for my two contracts (total £768.00). Not surprisingly, they did not have the signatures and the excuse was as bad as I had expected. He said the director was out for a meeting in Birmingham and no one else could sign them for me, but he promised that he would send the signed cheques to me on next Monday and I would definitely receive it on Tuesday. I knew it was a lie and I would never receive it if I couldn't get it on that day.

    3. I showed him the copy of my sent warning letter and told him I would go to MCOL at the next step, meanwhile, I would come back to their office again and again until all payments are made. Furthermore, I told him that all conversations including his excuse and "promise" had been secretly recorded and I would use it when necessary. Finally, I said I would come back in a few hours around 14:30 pm and 17:00 pm to see if their director comes back.

    4. Went back around 14:30 pm with a big surprise. :eek: I received two signed cheques (total £768.00) with no more argument and the whole process was quite smooth actually. I immediately saved them into my bank account.

    5. Anyway, I personally think it was a "victory" for me on last Friday although I will be keeping worried before the cheques are validated by the bank (needs 4 days).

    So, my opinion is - it absolutely worths a visit to their office if you can manage your time. Make sure that you will let them know you will not give up and are willing to come back again and again unless all payments are made.

    It’s my judgement day today. I went to see MCOL. Now the status has changed to defence entered. I read HMCS website and I understand that I will be sent a copy of the TMO’s defence and an allocation questionnaire to complete and later on go to the hearing. Can anybody tell me that how long do I have to wait before receiving TMO’s dispute and going to the hearing?

    I received mine in 3 working days. There will be a form to indicate whether you would still like to pursue the claim or not. I just sent mine informing the court that I would pursue the case.

    I think, it is purely a delaying tactics - as now a hearing date has to be decided which in all probabilities, TMO would not attend. If it puts off few of the customers from going down the legal route, it is an added bonus for them.

    I just hope that they are not going to go bust in next month or two :mad:

    No. Only one claimant per MCOL.

    Well done!!! Wish to god I didn't live 4 hrs away from Bradford as I would do the same. With that success, you shoud set up your own company getting people's money back for them!!!!! I'm filling out my mcol today, if i get my money back then i'm going on the campaign trail to out these crooks - if it's the last thing i do.

    What happens when they don't pay the amount awarded by the judge? A bailiff? Who do I call?

    If you want to use the bailiff, you need to apply to the court for a warrant of execution. (Fee involved, but it gets added onto the claim).

    Once warrant has been issued it is passed on to the bailiff for action.

    The enormity of my situation is just hitting home. I have only found this thread today...
    Got my contract with The mobile outlet in MAY 07 and sent off my 1st cashback claim that was accepted. Got an acceptance email way after the 28days saying it would be 45days, but gave them the benifit of the doubt over christmas. Sent my next claim through a few weeks ago and checked with the tracking system that it had been signed for (It had).
    Still no money!
    Tried the email address they quoted with no response....found the forum one on here- no response. Can anyone update me on the lay of the land....i'm trying to trawl through 119 pages of forum thread and getting quite worried!
