  • My MCOL has just had judgment rejected - I guess they will enter the usual defence of 'We sent you a cheque - here is the copy' rubbish.
I never received a confirmation email or any other email acknowledging my claim. They have never replied to any emails or snail mail - apart from the usual autoresponse. This approach will just cost them more in the long run - always assuming they stay in business!

When you issue a claim (either MCOL or via your county court) you should receive acknowledgement by way of a copy of the summons posted to you from the court.

There is no requirement for the defendant to acknowledge receipt, (or have any other contact), with the claimant.

I meant with the original cashback claim - sorry for any confusion.
The MCOL I followed online and was all very straight forward.

i've said this before, its their pony website, if you select by make of phone there are a lot more buying options, should you actually want to buy a phone through them :D . No cashback or any other gift offers though, just straight forward contracts.
  • I have just called the 0871 number, which was answered by a James Bruckwel, who said I should wait another 30 days for an e-mail response from the cashback team. I said I would rather come down and pick up my cheque in person, and asked him to confirm their premises address. He then gave me the Shipley address. Knowing them not to be located there, via this forum, I asked if they had an offfice in Bradford and he said no, just Shipley. I said I will ask for you in person when I come to pick up my cheque and he replied that they are not able to see visitors during working hours. I asked if I could see him outside working hours but he did not reply. The guy must be suffering from stress if he does not really know where he works:rotfl:
  • Hi, I was wondering if anyone can help me. Today I went to court in Northern Ireland and was awarded a decree by the judge for my full cashback entitlemmet, plus court costs against The Mobileoutlet. I phoned them today to advise them to pay the amount, but just got garbled nonsense about waiting another 45 days for payment 1 and 2. It looks as though I will have to enforce this decree to get my money back. Any advise of how to pursue this further will be greatly appreciated. BTW the judge from Northern Ireland said that I would need to get his decree resealed in the court in Bradford. Thx in advance.

If you read through the thead you will see that they don't take any notice of any court orders.

It seems you have to go all the way and get the bailiff involved to get a payment from them.
