No. Only one claimant per MCOL.

Can I claim for both my 2 phones on the same MCOL, Quentin stated one claimant, but is that claimant allowed to claim for 2 phones contracts taken out at the same time, same cashback claim rules etc, all cashback claims accepted in writing by TMO. I really need to find out quickly as I am about to put in my MCOL. Advice gratefully received :o

If you can get all the details about the two contracts (and identify them separately) into the allowed number of characters, then that is ok.
  • As the call centre is several thousand miles away in Bangladesh it's no wonder they don't know that Shipley isn't the same as Bradford.!!!
I didn't do it, nobody saw me do it, you can't prove a thing! ;)
    Quidco and Topcashback, £4,569
    Shopandscan, £2,840
    Tesco Double The Difference, £2,700
    Thomson EU261/04 Claim, £1,700
    British Airways EU261/04 Claim, EUR1200
  • Fantastic to find this forum with lots of advice, just when about to apply to MCO for 1st installment of cashback. Applied for it on 8th of Dec, and they are just out of the 45 day period for payment. (despite plenty of phone calls and recorded letters).
My question is: how many installments I can claim for at this stage?
They are in breach of contract in that they have not paid me the first installment due and are now outside the due period (despite receiving the papers in time).
I would like to claim immediately the 4 other installments rather than claim 4 more times!
    Has anyone else done this?
    Many thanks to everybody.

Wow what a long thread of unhappy TMO customers.

Just after a quick bit of advice. I've filed a claim with MCOL against TMO. Yesterday judgment was issued in my favour. I requested immediate payment.

I now have an option on the online MCOL system to send the bailiffs in. Obviously 'immediately' still needs to give them time to actually respond, so I was going to wait a few days now.

However reading the last few pages of this thread, it seems people are seriously concerned that they could go bust at any minute. Plus the fact that they apparently never pay up voluntarily.

So my question is, am I best off to just send in the bailiffs immediately now? At least that way if they do go bust / leave the country / etc, I will hopefully get my money back before that happens. Whereas if I do what I thought was the decent thing and wait a bit, I might lose out.

    What do you think ?

If you have read the thread you would see there is no point being decent - they ignore everything including decent and reasonable behaviour by their creditors.

They ignore ccjs, so if you think they have the funds, apply for a warrant of execution.

Though again read the thread to see their initial reaction to a bailiff's call!

    Hi quentin,

Yes i've spent ages reading through this thread - vey enlightening. That is what has got me so worried. I guess that the whole idea of just going straight to such drastic action, instead of being reasonable and giving them at least a chance, seems a bit alien to me. But I guess you are right.....in light of all the info on here maybe I should just go ahead with it.

I think I will do that tonight. All this talk about them going bust....obviously I can understand the reasoning behind it generally, but is there any specific reason as to why people suddenly think they will go bust v soon? Or is it just that they've been doing this 'scam' of cashback for so long that it is about due to fall down around them.

Actually one more thing. Online, when I proceed to fill in the warrant info, I see that I can amend the address if I want to.

I filed the claim initially at the Riverdale House address, but people on here seem to be using:

MOBILE MATTERS (UK) LTD Trading as The Mobile Outlet
    UNIT 6 BANTAMS BUSINESS PARK
    VALLEY PARADE
    BRADFORD
    WEST YORKSHIRE BD8 7DY
    Company No. 04787711

Should I use this address for the warrant? And am I ok to change the address at this point? (the riverdale address seemed fine to use for getting a judgement)

    Thanks.

We cannot see how they can be viable if their only trading activity is via their website.

No-one who has been a customer of theirs would ever return, and there seems no incentive for new customers to trade with them.

Plus the current wave of their competitors going bust following similar histories concerning failure to honour cashback contracts.

You could add the Valley Parade address on as info for the Bailiff, though as you will have seen, they do know exactly where to find TMO!
