    Did you get defence by post or can you see it online? TMO has filed defence against my claim but I have no idea what they have said.
    If I was a betting man, I would guess that their defence is that they have already sent you a cheque in the post for the outstanding amount, quoting the cheque number, and stating that they bear no responsibility for any Royal Mail delays/losses.....but I'm not a betting man, so I wont

    Any reputable company getting a summons for unpaid money which they had paid would simply stop the lost cheque and issue a new one (using guaranteed delivery) immediately to save both the claimant and the court wasting any more time over this.

    Such a defence won't work - but will delay matters.

    I think the perceived ordeal of going to court may discourage some claimants from going any further once a defence has been received....not me. I'd rather have done it all online, but I am determined to get what they owe me by whatever legal means are available....

    I'm sure you're right.

    It's just cynical - and of course forces the claimant to invest more money in the exercise as nowadays the county court fee system means that a hearing fee must be paid if the defendant issues a defence. Many claimants will give up, rather than face the extra hassle - which we now know doesn't stop with the judgement.

    As I hinted at in one of my previous posts, It would be interesting to actually know how many claimants were unfortunate enough to have their cashback payments lost in the post...

    We sent the 1st claim for a new Contract (4th month - took out contract before I read this thread!) on the 21st Jan by Special Delivery and according to the Royal mnail website it was only delivered the 28th January.

    I'm assuming this means that the claims invalid now??
    Or could this be due to redirection? We posted to the address on the cashback vouchers!

    I just want to cry - it's stressing us out, as with this £500 odd, and the last 2 unpaid instalments, we're about £1000 down!

    I sent all my claims Special Delivery to the Riverdale House, Shipley addess and the last 3 were redirected, but it took only one extra day for the claim to get wherever it was redirected to. What makes you think your claims will be invalid????

    I posted my 4th set of bills to tmo on 12th december by Royal Mail and they got signed for on 4th January. The latest date they could receive my bill was 21st December so by fault of Royal Mail, this claim will probably be invalid. I thought 9 days would be ample time for them to get it there but obviously not. I would always use the guaranteed next day service from now on even if it is more expensive.

    my friend sent her bills to mobile outlet recently expecting it to be delivered few days late due to redirection.

    However royal mail has shown NO sign of any signature or confirmation of delivery even if it has been delivered.

    She will not use Recorded Delivery anymore.

    However she was advised by someone to send an empty envelope special delivery to themobileoutlet so that she can show the court when needed that they have received her claim.

    I know this sounds dodgy as there is nothing in the envelope. But can they prove that there is nothing in the envelope? if they can prove using CCTV cameras (don't know if they use it) then they should be able to prove for other victims of TMO that there is no missing dispatch note or part of a bill for other people.
