    Is the following adequate for claiming online for the 4th and 5th payment they are still yet to pay me:
    Despite receiving confirmation via email on the 3/10/07 that my cashback claim (ref. 18074243) was successful I am still yet to receive payment despite being told payment would be made within 28days.

    I have tried contacting them several times since, my last correspondence being the 7th January 2008 whereby I sent them a "Letter Before Action". Despite confirmation that this letter has been received. (ref: ZV 6472 9726 5GB with the royal Mail) they have not responded within my given deadline so I am now forced to persue this claim online.

    Despite complying with all the condidtions sending them in, they have comitted a relevant breach of the contract so I wish to sue for the whole amount owed to me of £189+ interest.

    The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 3rd November 2007 to 14th January 2008 of £2.99 {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.04158

  • I have a 12-month cash back offer. After having read the T&C's, I noticed one clause "To get your cash back, you need have paid your phone bill on time by Direct Debit by the date specified on the bill".

    My question is - If I need to make a claim, do I have to wait until the DD payment date (when the payment/bill for that month is transferred from the bank account), which is normally end of the month (and very close to the deadline of sending the bills), or can I send the bills before the actual payment date (i.e. before the payment of the bill of that month is made)?

    Another questions is - Do I need to send all the bills or only the recent one is enough?

    Hi all,

    I've been today to the unit at Bradford Football ground to collect my owed cashbacks. I don't know if the cheques will bounce.................... I hope not. I was told they're not issuing cashback cheques at the minute................... so the only way to get your money I suggest is to pay them a visit. I'll let you know when and if the cheques clear. I was owed just short of £600 for outstanding cashbacks.

    Bills, not DD date - that is one of their red herrings that they'd look to stop paying you if you changed method (like it matters to them)

    Just the one that it says in your T&C's and keep copies of everything you send (and I mean everything), oh and ALWAYS send RM Special Delivery.

    I'm guessing you'd done the usual chasing up and got nowhere?

    Were you after the 45 days from their expected date of receipt, date?

    ALWAYS send Rec Del.

    This is poor advice as far as dealing with TMO.

    "Rec Del" doesn't safeguard a letter, it goes via normal post. If it gets lost there is no compensation from RM.

    And, if your claim gets lost in the post, then you lose all your entitlement to any cashback at all.

    You should only use special delivery with consequential loss insurance.

    I hate for this to be my first post, but well, i'm in a state of disbelief.

    I've read over this thread and it has completely startled me. I came across it because i too have been having problems contacting TMO, and well, i've started to get worried.

    I was recommended to the TMO by a friend who's brother and sister had both successfully spent a year on the contract and received their money back, thus, i thought it would be a great idea to do it myself.

    Everything was alright at first, the phone and the contract were fine. I spoke to them on the phone and all the email business was done well.

    However, as i came closer to my first cashback date, i wanted to make sure that i was going to do the cashback the right way. I sent an email; no reply. I sent another; no reply. I sent a third; no reply. So, i began ringing them. Still, i get no reply from them (the number which i use is 0871 4273 500). It just rings and rings and rings and rings...

    So.

    I was wondering.

    Should i save myself the bother of seeing if they give me cashback and risk losing more money?

    Or, should i just ring up O2 and cancel my contract?

    Any input is appreciated, thanks a lot.

    Odds are O2 won't let you out of your contract without having to buy your way out so you should go after TMO.

    I'm thinking about doing the same.How far are their offices from Bradford Interchange station- walk/bus/taxi? Did you ask for anyone in particular? Did you take any paperwork with you- did they go through anything or just ask you to wait and give you a cheque.
    Shouldn't really have to do this but they owe me £360 and I've got credit card bills that need paying!!
