    You request a warrant of execution from the court.

    If that is granted, it is passed onto the court bailiff for action.

  • Some people have posted accounts of TMO back dating cheques when bailiffs turn up to avoid paying bailiff fees.

    Can this be prevented by specially instructing court bailiffs to accept amount owed + their fees?

    Bailiffs will try to recover the amount on the warrant (which will include the fee paid to court for issuing the warrant).

    Should any payment come direct from the defendant you inform the bailiff and they will try to collect any balance owing.

  • Hi, I have gone through the process of using MCOL and TMO defended my claim. So I then had to complete a Allocation Questionnaire, which I sent off before Xmas. Today I received a General Form of Judgment or Order, which states,

    Unless by 4pm 17th January 2008 on the the Defendant files at Court a completed Allocation Questionnaire and pays the Court Fee on the Counterclaim:
    (i) the Defence may be STRUCK OUT and the Claimant be entitled to enter judgement
    (ii) the Counterclaim may be STRUCK OUT.

    What does this mean? Are the courts waiting for TMO to complete an Allocation Questionnaire?

    hi, yes they are. i was i the same situation. TMO failed to send back the questionnaire, i sent form N225 to the local court to enter judgement.
  • Thanks for replying, glad to hear I am not the only one. So I take it, you never had to go to court?
