  • Hey all,

    Does anyone know where you stand legally if TMO don't send you the cashback vouchers so you can make your claims, and ignore the stern letter you write them asking them to send you them in the next 14 days or you will take the case further? Is it grounds for an MCOL case? I was going to go to Trading Standards again to day to give them the unsurprising news and ask what to do next, but they were shut, so seeing as they won't be open until Monday, I thought I'd ask here and see if anyone had the same problem.

    Previously Trading Standards told me to write a letter to them and to O2 explaining the problem and also their non-compliance with the code of practice. Unsurprisingly TMO said nothing. O2, however, said they would pursue the case provided I gave them my mobile number (data protection, rookie error on my part), which I intend to do on Monday.

    Any advice anyone?

    It would appear that the only thing that TMO take notice of are bailiffs knocking on their door. If you haven' begun the legal process yet, then I suggest you start it now. Send them a LBA giving them a chance to pay up, then go down the MCOL route. They are even ignoring CCJs, so you need to be prepared to go all the way and use the bailiffs to get your money....

    Oxheys, that must be the Vally Parade address, is it? Thay haven't moved again, have they? I decided no to go today as the weather was awful but if MCOL is not back up tomorrow I probably will- anyone else going tomorrow?

    You want to be in the middle of 3 contracts mate, that's £1330 I might lose.

    As for stopping them, I really don't want anyone doing anything that allows them into a creditors compulsory liquidation, as we will all lose everything (as they will have no assets).

    Think about it, they get commission on sales as income and will lose that if they cease trading, at least if we turn up on the door (or use bailiffs through MCOL) then we are simply taking some of their income stream. If that stream goes (by the networks refusing to deal with them) then they really won't have any money with which to pay cashback.

    You can bet that the Directors have set themselves in a nice position with several Directorships and won't see themselves on the street.

    Now MCOL back on line I wanted to file proceedings against TMO asap but having had to cancel one MCOL I dont want to mess up another one

    update -
    i sent a claim via the MCOL site already mentioned in this thread, and didnt bother with the LBA as it was obvious they weren't responding to any of my e-mails or anyone elses.

    today i received a response both via the court and mobile outlet themselves.
    they claimed that they sent me a cheque covering 2 x claims back in November, and even showed a photocopy of the cheque !!.

    they included a cheque for the outstanding amount, which i hurriedly put in the bank today, so as far as i am concerned i am happy enough.
    i have 2 further claims potentially still to come, but cant be bothered with the hassle, and have instead got t-mobile to reduce my monthly tariff for the last 2 months. the value isnt the same, but the hassle just isnt worth it.

    I just re used my original log in and also used the same 'reasons' as before the only change was the amount of interest I'm claiming as it has gone on a few more dayes but DONT do the same as me and forget to add the interest onto the total claim. For some reason, I thought that mentioning in my 'reason' to take legal action, was enough but realised afterwards (i think:confused: ) that I should have added it onto my total claim. It was only £6.06 so if I can get my cashback minus the interest, I feel that I have won don't you think??:(

    If you just completed the claim today you can cancel it and get your fee refunded and start again.

    You need to ring them first thing on Monday (before 10.00) if you want to do this.

    (If your claim is successful, then the interest part will be increased - you amend the amount of interest when you apply for judgement to take into account the period between your claim and the date of judgement.)
